Will of Philip Penny from Newfoundland will books volume 14 page 307 probate year 1928

In re       DECEASED.
      PHILIP PENNY.

This is the last will and testament of me Philip Penny of North Arm, Holyrood in the island of Newfoundland, Engineer.

  1. I hereby revoke all former wills at anytime heretofore made by me.
  2. I appoint my wife Margaret Penny as sole executrix of this my will.
  3. I devise and bequeath all monies standing in my name and to my credit in any bank or banks in the island of Newfoundland to my wife Margaret Penny my executrix herein to be hers absolutely.
  4. My dwelling house, barn, lands, farming implements, furniture and everything appertaining thereto and being thereupon at the date of my death I devise and bequeath to my wife Margaret Penny absolutely provided however that should she remarry after my death then the house barn, lands, implements, furniture, and appurtenances shall belong to my two sons William and Michael in equal shares. As to the land the North East shall belong to Michael and the North West half to William.
  5. My boat I bequeath to my two sons as tenants in common.
  6. My watch I bequeath to William.
  7. My Picture I bequeath to William.
  8. All the rest and residue of my property whether real or personal not hereinbefore devised or bequeathed I devise and bequeath to my wife Margaret Penny absolutely, provided however that should she remarry then the same shall devolve as the previous bequest mentioned in Paragraph IV hereof.

Signed by the said testator by making his mark hereto this 21st day of July A.D. 1928 in the presence of both present at the same time who at his request signed our names hereto as witnesses. Before making his mark hereto the said will was read over and explained to the Testator who appeared to understand the same perfectly and satisfied with its terms.
