Will of John Penny
from the Newfoundland will books volume 12 page 131 probate year 1921

In re JOHN PENNY.      DECEASED.

Last Will and Testament. I, John Penny, of the township of Fortune, District of Burin, Dominion of Newfoundland, being of sound mind, manner and understanding, do make my last will and testament in manner and form following.

  • FIRST. I devise and bequeath to my daughter, Violet Martin, her heirs and assigns forever my house and all its contents and any monies now held by me in said house and the surrounding land; also one thousand dollars ($1000.00) in cash now held by the Bank of Nova Scotia, Fortune.
  • SECOND. I devise and bequeath unto my grand daughter, Nancy Jane Martin, the sum of one hundred dollars ($100.00) to use for her schooling now held at the Bank of Nova Scotia, Fortune.
  • THIRD. I devise and bequeath unto my daughter, Sarah Maude Hawco, the sum of three hundred and fifty dollars ($350.00) now held at the Bank of Nova Scotia, Fortune.
  • FOURTH. I devise and bequeath unto my grand daughter, Violet Naomi Hawco, the sum of one hundred dollars ($100.00) now held at the Bank of Nova Scotia, Fortune.
  • FIFTH. I devise and bequeath unto my son, Sidney Penny, the sum of three hundred and fifty dollars ($350.00) now held at the Bank of Nova Scotia, Fortune.
  • SIXTH. The sum of five hundred dollars ($500.00) with interest now held by the firm of Lake & lake to be held in trust by my executors, Namely: H. B. Clyde Lake and Thos. E. Spencer to provide a head stone and any other necessary expenses, and to provide for the maintenance of the home till this amount is expended.
  • SEVENTH. Any balance left at the Bank of Nova Scotia will be for the use of my executors so named for any expenses that may occur in settling my estate.
  • EIGHTH. I hereby appoint as my executors in this my last will and testament H. B. Clyde Lake and Thos. E. Spencer.

In Witness Whereof, I, John Penny, the testator have to this, my last will and testament set my hand and seal, this twenty eighth day of May, A.D. 1921. JOHN PENNY.
Signed, Sealed and published and declared by the above named, John Penny, as and for his last will and testament in the presence of us, who have hereunto subscribed our names at his request, as witnesses thereto, in the presence of the said testator and of each other. Witness. A.S. Adams    W.P. Lake.

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
