The Will of Edward Pudner of Bonavista - 1819

From The Prerogative Court of Canterbury

 

I Edward Pudner of Topsham in the county of Devon but now residing at Bonavista in the island of Newfoundland in North America being of sound and collected mind but mindful of the uncertainty of human life and in order to prevent any dispute or doublt arising from my decease as to the disposition of the property it has pleased God to endow me with do make and publish these my last will and testament in manner following. To my loving wife Mary Pudner I give and bequeath all that plantation or fishing room situate lying and being at Bonavista aforesaid commonly called or known by the name Sheppards room lately purchased by me from Mr. Benjamin Lester and Co. with all the erections and appurtances there onto belonging to to have and to hold the same during her natural life and it is my desire and wish that she shall leave the same by will to whoever she shall please to favour with it at her decease also every part and parcel of my household furniture goods chattels plate and silver. To my loving sister Esther White of Topsham but now residing at Greenwich I give devise bequeath the sum of one hundred pounds of lawful money of Great Britain to to have the same to her own proper use for ever to be paid her by my executors herein after named within twelve calendar months after my decease. To my niece Fanny White oldest daughter of the aforesaid Esther White or by what ever name she may be known or called I give devise and bequeath the sum of fifty pounds of lawful money of Great Britain to have and to hold the same to her own proper use for ever to be paid by my executors within twelve calender months after my decease. To my niece Sophia White second daughter of the aforesaid Esther White or by whatever name she may be known or called I give devise and bequeath the sum of fifty pounds of lawful money of Great Britain to have and to hold the same to her own proper use for ever to be paid by my executors with in twelve calendar months after my decease To my surviving nephews and nieces sons and daughters of my sister Ann White deceased I give and bequeath to each and every surviving one after my decease the sum of fifty pounds of lawful money of Great Britain to have and to hold the same to their own proper use forever to be paid them by my executors within twelve calendar months after my decease. To Andrew Tavenor of Trinity oldest son of Andrew and Catherine Tavenor I give and bequeath the sum of fifty pounds of lawful money of Great Britain to have and to hold the same to his own proper use forever to be paid by my executers within twelve calendar months after my decease.
To George Robbins of Poole but now residing at Bonavista I give devise and bequeath the sum of fifty pounds of lawful money of Great Britain to have and to hold same to his own proper use he and his heirs To be paid by my executers within twelve calendar months after my decease To my nephew Robert White late of Topsham but now residing at ???? I give devise and bequeath all my wearing apparel linen collars To David Durell of Poole I give and bequeath the sum of five pounds to purchase a piece of plate as a token of rememberence to Abraham Ackerman the elder of this place I give and bequeath five pounds to purchase a suit of mourning to ??? of my executors herein after named I give devise and bequeath the sum of twenty pounds to purchase a piece of plate ?? as a token of rememberence the residue and remainder of my ? estate I give devise and bequeath to my executors in trust hereinafter named for the purposes of my will that is to say that after all my just debts and funeral expencies is paid they shallpayout and invest the same in parliamentary stocks or funds or on real or goverment securities at interest as they shall think fit and as the dividends and profits thereof become and pay the same to my loving wife Mary Pudner during her natural life and so to hereby fully authorize and empower my executors in trust to increase the dividends there of till her decease and they the said trustees or the survivor of them his executors ??? or assigns shall pay tranfer and set over at the deceace of my wife Mary Pudner the princepal sum to the following purposes one hundred pounds to George Garland Esquire his executors administrators or assigns to be distributed by his or their agents at Bonavista ten pounds per anum for ten years in clothing and provisions to distressed objects of charity of and belonging to this place five hundred pounds of lawful money of Great Britain to my only surviving sister Esther White but should she not be living at the decease of my wife this sum is to be appropriated to the purposes of the will here after mentioned the same as if no such person had ever existed to the intent and meaning that surviving  nephews and nieces shall share and share alike at the decease of my wife the residue and remainder of my estate to be divided equally among all and every one of my nephews and nieces sons and daughters of my sisters Esther and Ann White surviving at the decease of my said wife share and share alike to their own proper use they and their heirs for ever also by this will and testament I consitute and appoint George Garland Esquire Joseph White Jeffery and David Durell Bird all of the Town and county of Poole in Dorsetshire executors and trustees to this my last will and testamant contained in one sheet of paper and it is my desire that a copy of this my will maybe sent to them as soon as convenient that they may take the most efficent means to carry it into effect and I do hereby revoke all former and other wills by me at any time hereto for made declaring this to be my only and true will. In witness where of I the said Edward Pudner Capt hereonto set my hand and seal at Bonavista afore said this twenty six day of November in the year one thousand eight hundred and six.

Signed sealed and published and so ordered by the said testator as for to be his last will and testament in presence of us who in his presence and in the presence of each other have here on to set our names as witnesses thereof

Proved at London 7th January 1819 before the Judge by the oath of George Garland Esquire and Joseph White ????? here to for Joseph White ?????? Esquire The surviving executore to whom admon was granted being first sworn ( by cannon ) only to administer


Transcriber notes

Edward Pudner was to the best of my knowledge a ships captain who sailed from Newfoundland to England and elsewhere
The will clearly states that he purchased a fishing room from Benjamin Lester and Co called Sheppards room this Sheppards room must be room # 64 in Bonavista register called Shamblers room !
