WILL of RACHAEL (THISTLE) MCKIE

IN THE NAME OF GOD AMEN.

I Rachael McKie of St. John's in the Island of Newfoundland widow of Peter McKie late of the same place Esquire being of sound mind and memory but remembering the mortality of my body do make this my last will and Testiment in manner following And I do appoint my sons in law William Tarbet of Liverpool Merchant Frederick Bullock of Woolwich in the County of Kent a captain in the Royal Navy and my worthy friend Thomas Holdsworth Brooking of the city of London Merchant Executors of the same having by Deed bearing date the third day of September last settled and disposed of all my real estate in the trust for my children ______ therefore my will

is and I so direct that soon after my decease as may be practicable my said Executors do sell and dispose of to the best advantage and convert into money all my household furniture movable and personal property whatsoever and wheresoever and out of the proceeds thereof do and shall pay and discharge all my just debts and funeral expenses as also the expense of proving this my will And I hereby further direct and my will is that my said Executors shall and do collect realize and convert into money all my monies debts and securities for money of what kind or nature soever as well in Great Britain as elsewhere And that they my said Executors shall and do divide the whole of my said personal estate so realized together with the surplus proceeds of my movable property into four even equal shares and proportions And I do hereby give and bequeath one fourth share of my said personal estate to and among the children of my late daughter Rachael Tarbet wife of William Tarbet aforesaid share and share alike the same to be applied to and for the benefit of the said children in such manner as their father the said William Tarbet shall deem most advisable for their interest I give and bequeath unto oath of my daughters Agnes O'Farrell and Elizabeth Bullock respectively one fourth share of my said personal estate And I hereby direct my said Executors to pay the said fourth shares into the hands of thou the said Agnes O'Farrell and Elizabeth Bullock respectively for their sole and separate use free from the debts or control of any husband or husbands with whom they or either of them is or are married or may intermarry And I hereby declare that the receipt or receipts of them the said Agnes O'Farrell and Elizabeth Bullock respectively or such person or persons as they or either of them shall appoint shall sufficient discharge or discharges for her or their shares or respective share aforsaid And as to the remaining fourth share of my said personal estate I do hereby give and bequeath the same unto the said William Tarbet Frederick Bollock and Thomas Holdsworth Brooking and the survivors and survivor of them his executors administrators and assigns upon and for the trusts intents and purposes following that is to say upon trust that they the said William Tarbet Frederick Bullock and Thomas Holdsworth Brooking and the survivors and survivor of them his executors administrators and assigns shall and do lay out and invest the same on interest to the best advantage either in Great Britain or elsewhere as they may think fit And from time to time alter vary and transfer the monies so laid out and invest for or unto other securities of the like nature as they or he shall think advisable And upon this further Trust that they the said trustees or trustee for the time being his executors administrators or assigns do and shall during the lifetime of my daughter Caroline Langhorne wife of Thomas Greensill Langhorne pay the interest dividends and yearly profits of the said monies so laid out and invested as aforesaid into the hands of her the said Caroline Langhorne or to such person or persons as she shall whether covert or sole by any writing under her hand from time to time appoint to the intent that the same may be for her separate use and not subject to the debts control or interference of her present or any future husband And the receipt or receipts of the said Caroline Langhorne for the said interest dividends and yearly profits or of the persons or person she shall appoint to receive the same shall whether she shall be covert or sole be an effectual discharge or effectual discharges for the money therein acknowledged to be received

And from and after the death of the said Caroline Langhorne upon trust that they the said trustees or trustee for the time being his executors administrators or assigns do and shall pay and apply the said interest dividends and yearly profits accruing as aforesaid and for the support duration and maintenance of the children of the said Caroline Langhorne yearly until the youngest child shall attain the age of twenty one years when and upon which event I do hereby direct the said trustees or trustee for the time being his executors administrators or assigns to pay transfer and distrubute the said principal monies so laid out and invested as aforesaid and is in prising the said fourth share to and among the children of the said Caroline Langhorne who may then be living in even and equal proportions share and share alike Lastly I do hereby revoke annul and make void all former wills by me at any time made in witness whereof I have this twelfth day of April in the year of our Lord one thousand eight hundred and thirty seven to this my last will and Testament my hand and seal at St. Johns in the Island aforesaid Rachel McKie. ---- Signed and sealed by the above named Rachael McKie and by her published and declared as and for her last will and testament in the presence of us whom have thereto in her presence and in the presence of each other subscribed our names as witnesses Daniel I? or L? Ward, B.G. Garrett, Willm B? or R? Calver.

Proved at London the 13th Jan 1845 before the judge by the oath of William Tarbet one of the Executors to whom ____ was granted having been first sworn by Commission duly to administer power observed of making the life grant to Frederick Bullock Esquire and Thomas Holdsworth Brooking the other Executors when they shall apply for the same.


Rachel McKie was the daughter of Thomas and Amy Thistle of Hr. Grace.
