The Will of Henry Brown of Salvage - 1846 From The Prerogative Court of Canterbury
In the name of God amen I Henry Brown of Salvage Planter in the Northern district of Newfoundland being sick and weak of body but of perfect mind and memory do make and constitute this to be my last will and testement in the manner following That is to say after my just debts funeral expenses and charges of providing this my last will and testament being in the first place fully and lawfully paid and satisfied and after payment of every part thereof as ??? my worldly affairs whereof it has pleased God to bless me with in this life. I give ??? and dispose of the same in manner following that is to say I give and bequeath to Hanna my beloved wife all my lands goods and chattels situated in Salvage Bonavista Bay Northern district of Newfoundland aforesaid subject to the undermentioned clauses That is to say my dearly beloved wife is to have the management of all my affairs for the benefit of herself and our children during her natural life but should she live until James, John and William our sons attain the age of eighteen years and they should wish to separate from their mother then I will that what property should then be remaining to be equally divided between my beloved wife and my three sons say one quarter each my wifes part for her natural life and then to fall to my three sons, our three girls to be to be under the management of their dear mother and brothers to be taken care of until they shall be otherwise provided for but if in case my beloved wife should die before the girls are provided for their brothers are to support them with ??? money I shall shall die possessed of I will that it be under the ???
of beloved wife as well what is in England as well what is in this country to be equally shared between my beloved wife and my three sons but as unforseen circumstanes may arise and part of this money may be wanted for the trade I will that my wife and my sons bear each a proportional part until the sons separate from their mother Then they are to have their part of what remains, what money is in Mr. Birds hands in England is the property of Hannah my beloved wife and at her disposal. I also constitute appoint make & ordain John Mifflin of Bonavista Merchant and Joseph Brown of Kings Cove Planter my executors to this my last will and testement in case of any misunderstanding between my beloved wife and her children I also have to request my brother Joseph Brown to see that my children be taken care of and brought up in the fear and virtue of the Lord. I hereby confirm this to be my last will and testament in witness whereof I have hereon set my hand and seal this ninth day of December in the year of our Lord His Signed sealed and delivered by the said testator Henry Brown as and for this last will and testament in the presence who in his presence and at his request and the presence of each other has subscribed our names as witneses to. Proved at London the 4 August 1846 before the Judge by the oath of of John Mifflin and Joseph Brown the brother of the deceased The executors to whom ??? was granted having first been sworn by ??? duly to administer Transcribers Note Henry Brown died at age 45 years on January 19 1840 and is buried in Bonavista close to his Grandfather William Brown Esq.
