Will of John Joseph Oxley
from Newfoundland will books volume 13 pages 73-74 probate year 1925

In re
      JOHN JOSEPH OXLEY.     DECEASED.

This is the last Will and Testament of me John Joseph Oxley at present residing at 3 Rosslyn Avenue Low Fall in the County of Durham I appoint my wife Annie Oxley my cousin Thomas Oxley of South Moor in the County of Durham and Annie Wintrip of 22 North Eastern Railway Cottages, Washington Station in the County of Durham Spinster to be the Executors and trustees of this my Will I direct my executors to pay my just debts funeral and testamentary expenses and subject thereto I give devise and bequeath all my Estate and effects whatsoever and wheresoever to which I shall be entitled at the time of my death to my trustees as to one moiety thereof In trust for my said wife absolutely and as to the other moiety to be held by them in trust for my adopted son John Oxley Wintrip to be paid to him on his attaining the age of Twenty one years and I authorize my trustees to pay or apply the whole or any part of the income of the said moiety held in trust for the said John Oxley Wintrip and if the said income be insufficient to raise any part or parts of the capital of the said moiety and apply the said income or capital whilst the said John Oxley Wintrip is under the age of Twenty one years in such manner as my Trustees shall think fit in or towards the maintenance education benefit or advancement in life of the said John Oxley Wintrip Provided that if the said John Oxley Wintrip shall die before he attains the age of twenty one years then I give devise and bequeath the moiety held In trust for him as aforesaid or so much of the same as shall not have been applied as aforesaid together with the unapplied income (if any) thereon to my brother Frederick Stephen Oxley absolutely or if he shall then be dead to the said Annie Wintrip absolutely I revoke all Wills at any time heretofore made by me and declare this to be my last Will and Testament. In witness whereof I have hereunto set my hand this twenty eighth day of September One thousand nine hundred and twenty one.
