Will of Joseph Emberly

In the name of God Amen I Joseph Emberly Sen. Late of the parish of Christ Church Hampshire England but now residing in Great Burin Placentia Bay Newfoundland being in perfect mind and memory but weak and sick in body do make this my last will and testement. That is first to God I commend my soul into the hands of Jesus Christ my merciful redeemer hoping that he will save it with a present and everlasting salvation and I commit my body to the earth from which I had it, leaving it to the discretion of my executor to give it decent christian burial. And as touching those worldy goods with which it has pleased God to endow me , I will and bequeath them in the following manner, that is to say first of all I give will and bequeath to my well beloved wife Elizabeth Emberly the third part of all my stage, flakes, boats, skiffs and punts , also of all the craft thereonto belonging together and the third part of all my gardens and meadows now in my possession to be hers during her natural life and at her death to be equally divided between my two sons William and Samuel Emberly and it is my will that my said wife shall have all the tables in my house with all the tables furniture to be soley at her own disposal to give them at her discretion to whom she pleases.
Secondly I give and bequeath to my two sons William and Samuel Emberly the other two thirds of my said room , stage, flakes, gardens, meadows, boats, skiffs, punts and craft now in my possession to be equally devided between them to be theirs and assigns forever and it is my will that the house I now live in shall be my son Williams but not till after the death of my wife Elizabeth Emberly and I will and bequeath to my son Samuel that building called new house to be his , his heirs and assigns for ever and it is my will that the first of my sons Samuel or William that should marry if before the death of my wife is to live the new house aforesaid after my decease. And I will that my wife Elizabeth Emberly is to have sole management and direction of the business which may be carried on by my two sons Samuel and William Emberly during her natural life. And it is my will that my son John is to have that spot of ground on which on which he is now begining to build a house, that is to say he is to have thirty five by eighteen and I will and bequeath to my grandson Joseph Emberly three pounds of lawful money of Great Britain to be paid him three months after my death and I will and bequeath to my grandson Stephen Addams three pounds of lawful money of Great Britain to be paid him three months after my death, and I will and bequeath to my grandson Urich Brown three pounds of lawful money of Great Britain to be paid him three months after my death and it is my will that if my son Thomas Emberly does by actions give evidence that he has amended his ways if he leaves the place and family in which he has lived the last five or seven years past that he is to have seventy five feet by sixteen whereon to build a house in the place where James Brown house to be his, his heirs and assigns for ever, and that he is to have room in the stage and flake to make a resonable ??? skiffs fish paying a proportionate share of the expence in keeping up the stage and flakes but if he does not leave that place and family aforesaid it is my will that he shall have one shilling and no more and it is my will that my grandson James Emberly is not to be seen in want , that is to say my two sons William & Samuel Emberly is to give him reasonable assistance if able till he is able to do for himself and it is my will that my wife Elizabeth Emberly be the joint executor of this my last will and testement.
In witness where of I set my hand and seal this third day of May in the year of our Lord one thousand eight hundred and twenty four.

I certify that Elizabeth Emberly widow of the above named Joseph Emberly appeared before me and duley proved the foregoing as the last will of the said Joseph Emberly deceased on the thirteenth day of September one thousand eight hundred and twenty seven and recorded by me on the fourth day of October in the year last mentioned.
