Will of Elizabeth Harriet Osmond

In re Elizabeth Harriet Osmond       deceased

Know all men by these presents. That I, Elizabeth Harriet Osmond of Mortons Harbor, New World Island, in the District of Twillingate, Island of Newfoundland, being in good health and of sound and disposing mind and memory, do make and publish this my last will and testament hereby revoking all former Wills by me at any time heretofore made. And as to my worldly possessions and estate and all property real personal, or mixed of which I shall die seized and possessed or to which I shall be entitled at the time of my decease. I devise bequeath and dispose thereof in the manner following, to wit:-

First my will is, that all my just debts [if any] and funeral expenses, and a suitable headstone placed over my grave, shall by my executors hereinafter named be paid out of my Estate as soon after my decease as shall by them be found convenient. I give, devise, bequeath to my beloved daughter Hannah Osmond all my part [third] of the Water side premises with all erections thereon, and now occupied by my two sons, doing business under the name of D.P. & L. Osmond. Dwelling house with all household furniture and all other household effects, and all other lands and effects bequeathed to me by my late husband Mark Osmond. All monies that may belong to me, whether invested or otherwise and all of the residue of my estate, real personal mixed, of which I shall die seized and possessed, or to which I shall be entitled at my decease, I give, devise and bequeath to my said beloved daughter Hannah Osmond, to have and to hold the same together with all profits and income thereof to her the said Hannah Osmond, her heirs executors, administrators and assigns to her and their sole use and benefit for ever. And lastly I do nominate my brother Andrew J. Pearce of Twillingate Sub-Collector, and my friend Charles D. Mayne J. P. of Twillingate Accountant to be the executors of this my last will and testament. In testimony whereof I the said Elizabeth Harriet Osmond have to this my last will and testament subscribed my name and affixed my seal this eighteenth day of August in the year of our Lord one thousand nine hundred and fifteen. Elizabeth Harriet Osmond. Signed, sealed, published and declared by the said Elizabeth Harriet Osmond as, and for her last will and testament in the presence of us, who at her request, and in her presence, and in the presence of each other have subscribed our names as witnesses thereto. Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
