Will of James O'Flaherty
from Newfoundland will books volume 6 pages 56-57 probate year 1893

Last Will and Testament of
James O'Flaherty of St. John's
General Outfitter deceased.

      This is the last will and Testament of me James O'Flaherty of St. John's in the Island of Newfoundland General outfitter -

First I give and bequeath to my mother Eleanor Kinsella O'Flaherty the sum of one thousand dollars.

Second. I give and bequeath to my sister Annie O'Flaherty the sum of Two hundred dollars, to my sister Margaret O'Flaherty the sum of Two hundred dollars and to my sister Eleanor O'Flaherty the sum of Two hundred dollars.

Third. I give devise and bequeath to my wife Elizabeth O'Flaherty all the rest residue and remainder of my property estate and effects of every description.

Fourth. I appoint my brother John O'Flaherty executor of this my last will and testament.

Fifth. I hereby revoke and annul all other and former wills and testamentary dispositions by me at any time made or executed and declare this to be my last will and testament. Witness my hand at St. John's aforesaid this eleventh day of November Anno Domini one thousand eight hundred and ninety three (sgd) J. O'Flaherty. Signed Published and declared by the said Testator as and for his last will and testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses. (Sgd) W. O'D. Kelly (sgd) W. E. Wood

Codicil

This is a codicil to the last will and Testament of me James O'Flaherty of St. John's Outfitter which bears date the 11th day of November A.D. 1893. Whereas by my said will I appointed my brother John O'Flaherty of St. John's accountant to be the executor of my said will. Now I hereby appoint my wife Elizabeth O'Flaherty to be an additional executrix of my said will and I declare that my said will shall be read and construed as if the names of the said John O'Flaherty and Elizabeth O'Flaherty were inserted therein instead of the name of the said John O'Flaherty and that all the trusts and powers in and by my said will reposed in and made executable by the said John O'Flaherty shall be serviceable by the said John O'Flaherty and Elizabeth O'Flaherty and in all other respects I confirm my said will witness my hand at St. John's aforesaid this 13th day of November A.D. 1893. (Sgd) J. O'Flaherty. Signed Published and declared by the said Testator as and for a codicil to his last will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses. (Sgd) W. O'D Kelly (sgd) W. E. Wood
