Will of Augustus O'Brien (Collins)

He served as a Captain in the First Newfoundland
Regiment, under the name O’Brien. He died 18 October 1916.
In re AUGUSTUS O’BRIEN deceased. This is the last will and testament
of me, Augustus Collins, usually known by my adopted name of Augustus
O’Brien of St. John’s in the Island of Newfoundland, a Captain in his Majesty’s
First Newfoundland Regiment. I revoke all
former wills by me at any time made, and I appoint Charles O’Neill
Conroy of St. John’s, aforesaid, one of His Majesty’s Counsel,
the executor of this my will. I give and bequeath my books and my show-card
outfit to my friend Philip Brown, my Knights of Columbus sword to my friend
John J. Sinnott, and my clothes and other personal effects to my brother
Peter Collins. I give and bequeath my house
Number 25? Lime Street, St. John’s, to my said executor, upon trust
to permit my adopted father and mother, Thomas and Bridget O’Brien,
to enjoy the rents and profits thereof during their lives and the life
of the survivor of them, and thereafter upon trust to convey the same to
my brother and sister Peter and Minnie Collins in equal shares, or to the
survivor of them, should either be then dead.
All the rest, residue and remainder of my property, including my money
in the Savings Department of the Bank of Montreal at St. John’s,
Account No. 2596 in the name of “A.G. O’Brien”, my insurance
policy of One thousand dollars in the Knights of Columbus, Certificate
Number 84129, the amount standing to my credit on the books of my late
employer Mr. Garrett Byrne, and my investments in the Fidelity Club, Edson
Point, and Columbus Hall Company Limited, I give and bequeath to my said
executor upon trust to continue the present investments thereof or to vary
the same, at his discretion, and to stand possessed of the same, both as
to principal and as to income, for the support and maintenance of my said
adopted father and mother and the survivor of them, and after the death
of the said survivor then upon trust to pay the balance in equal shares
to my said brother and sister, or to the survivor of them, should either
then be dead.
And I specially
declare that my said insurance policy in the Knights of Columbus, although
expressed upon its face to be payable to my said sister Minnie, is intended
by me to form part of the residue of my estate hereby bequeathed upon trust
to my executor as aforesaid, and in the event of my said sister’s
claiming or retaining the same as against the claim of my said executor,
it is my will that she shall take no benefit from my estate, and that the
residuary trusts of this my will shall be for the benefit of my said brother
Peter only, to the exclusion of my said sister. Witness my hand at St. John’s
this third day of October A.D. One thousand nine hundred and fourteen. Augustus
