Will of Mark Oates
from Newfoundland will books volume 12 pages 505-506 probate year 1924

In re
      MARK OATES.          DECEASED.

I, Mark Oates, of the town of Carbonear, in the Electoral District of Carbonear, Newfoundland, being of sound mind, memory, and understanding, do make my last will and testament in manner and form following:

  • FIRST:     I desire that my funeral expenses be paid from my estate.

  • SECOND:     I give, devise and bequeath unto my son Edward, the whole of my dwelling house, with all things contained therein; and all land surrounding it, with all barns, buildings or outhouses built on it.

  • THIRD:     I give, devise and bequeath to my Grandson William, son of Edward, my land situate on the South Side of Carbonear, and bounded as follows:
    On North by Road, running by Pond Side.
    .. East     .. Land owned by Mr Rossiter.
    .. South ..     Public Road, leading west called Long Drung.
    .. West     .. Land occupied by Mr. G. Oates.

  • FOURTH:     I give devise and bequeath to my son Edward all my land situate on English Hill; that part under fence being bounded as follows:
    On North by Public Road leaving East from Bennett’s Hill.
    .. East     ..    ..    .. Commonly called Best’s Hill.
    .. South     .. Land owned by Howell’s.
    .. West     ..    ..    ..    .. Mills.
    the remaining part not fenced leads north from this and is situate on West Side of Mr Chas Frampton’s property.

  • FIFTH:     I give, devise and bequeath to my son Edward a piece of land on North Ridge of Carbonear, extending out towards Gadden’s Marsh, through wich Bay de Verde Railway runs.

  • SIXTH:     I hereby appoint William R. Thoms executor of this my last will and testament.

  • SEVENTH:     I further desire, that all property possessed by me at my death, whether it be money or any kind whatsoever, not provided for by this will, or disposed of previous to my decease, the same shall belong to my son Edward.

    In witness whereof, I, Mark Oates the testator have to this my last will and testament set my hand and seal this eleventh day of September, one thousand nine hundred and twenty two.    MARK OATES.

Signed, sealed & declared by the above named Mark Oates, as and for his last will and testament in the presence of us, who have hereunto subscribed our names at his request as witnesses thereto in the presence of said testator and of each other.
