THIS IS THE LAST WILL AND TESTAMENT OF ME, JONATHON NOSEWORTHY, presently residing at the city of Chilliwack, Province of British Columbia, but hereby declaring my domicile still to be the City of St John Newfoundland made this 31st day of July, in the year of Our Lord, one thousand nine hundred and twenty nine.
I REVOKE all former wills or other testamentary dispositions at any time heretofore made by me, and declare this only to be and contain my last will and testament.
WHEREAS all my estate was accumulated during the lifetime of my late wife, MARY ANN NOSEWORTHY, and WHEREAS by that marriage we had lawful issue of six children, hereinafter named;
AND WHEREAS in December 1925 I married my present wife, MARY NOSEWORTHY (nee MARY HILLIER), who had been my housekeeper for approximately four years prior thereto:
and whereas unhappy differences have arisen between the said MARY NOSEWORTHY and myself, consistently and continuously since our marriage, and the said MARY NOSEWORTHY, has been guilty of many acts of cruelty to me during that period, and has now declared her intention of living separate from me, and has not in any way contributed toward the accumulation of the assets of my estate;
AND WHEREAS on the second day of November, 1928, the said MARY NOSEWORTHY gave birth to a child, now also called MARY NOSEWORTHY;
I nominate and appoint my daughter Julia Milley, and my son Albert Noseworthy, both of whom are resident in Newfoundland, to be the Executrix and Executor of this my will.
I DEVISE AND BEQUEATH all my real and personal estate and effects unto my executors and trustees upon the following terms.
(a) I DIRECT all my just debts, funeral and testamentary expenses to be paid and satisfied by my executors, as soon as conveniently may be after my decease.
(b) I DIRECT my said executors to pay to the said MARY NOSEWORTHY the sum of one thousand 00/100 ($1000.00) Dollars which sum I consider to be adequate compensation to her for the period of time that she kept house for me since our marriage, and I consider her conduct toward me since our marriage has been such as to disentitle her to any further benefit from my estate. If my said wife, MARY NOSEWORTHY, predecease me, then this bequest is null and void.
(c) I DIRECT my said executors to pay, in equal share and absolutely, all the residue of my estate and effects, both real and personal unto my children; Julia Milley wife of W.J. Milley of Curling Newfoundland; Roland Noseworthy and Laura Hudson, both of Chilliwack, British Columbia, Frank Noseworthy of Mount Vernon, Washington, U.S.A.; Albert Noseworthy of Corner Brook, Newfoundland and the share of my deceased daughter ETHEL HOUSE, to be divided equally among her children; and the share of the infant MARY NOSEWORTHY in TRUST TO MY DAUGHTER LAURA HUDSON. (provided always that if any other child of mine shall die in my lifetime leaving a child or children who shall survive me, than in every such case the last mentioned child or children shall take (and if more than one, equally between them) the share his, her, or their parent would have taken of and in the residuary funds, if such parent had survived me).
I APPOINT my daughter, LAURA HUDSON, to be the Trustee of the share of the infant MARY NOSEWORTHY, and, jointly with my wife, guardian of the said infant MARY NOSEWORTHY. I empower and direct my said daughter LAURA HUDSON, from time to time and in such manner as she may deem necessary and advisable, to use any income or principal part of the said share of the infant MARY NOSEWORTHY for her maintenance and education, until the said Mary Noseworthy shall attain the full age of twenty one years, and the residue of such share, if any, is then to be paid by the said Laura Hudson to the said Mary NOSEWORTHY.
IN WITNESS WHEREOF I have hereunto set my hand and seal the day and year first above written.
