Will of Francis Noseworthy, from Newfoundland will books volume 15 pages 98 & 99 probate year 1930

IN RE.                               DECEASED

FRANCIS NOSEWORTHY.

This is the last will and testament of me, Francis Noseworthy of Clarke's Beach in the Island of Newfoundland, Trader.

  1. I revoke all former wills and testamentary dispositions by me heretofore made.
  2. I appoint my wife, Mary Grace, and Edgar Templeman of St John's to be executors and trustees of this my will.
  3. The storr and shop at Clarke's Beach known as the "Union Store" together with the land appertaining thereto, I will and devise to my son William Noseworthy. The piece of land at The Motion, nort to the land of Joseph Ralph, I will and bequeath to my son William Noseworthy. The barn situate near the Old Road to Port de Grave I will and bequeath to my son William Noseworthy
  4. All my land at North River and the erections thereon not otherwise disposed of in this my will and all my household furniture and personal effects I will and bequeath unto my wife Mary Grace to hold the same during her natural life. After the death of my said wife the same shall be equally divided amongst my children, children of a deceased child to take its deceased parent's share.
  5. I will and bequeath my revolving table to my daughter Rose Jackson.
    I will and bequeath my piano to my daughter Ada Smith.
    I will and bequeath my interest in the Marine Desk at Harbour Grace to my brother Jonathan Noseworthy.
  6. All the residue of my estate including all my stock in trade and all and singular my property of every description which is not otherwise disposed of in this my will, I will and bequeath unto my wife Mary Grace to hold the same during her lifetime with full power in my said wife to carry on the mercantile business now conducted by me in such manner as she may think fit or to discontinue the same at any time according to her unquestioned discretion.

In the event of my wife carrying on the said business I direct that she shall at the close of each year's business set aside the profits thereof after paying all current expenses of the said business, including wages to herself and such of my daughters as may assist her in the said business for the purpose of distributing the same or hereinafter stated.  After the death of my said wife I will and bequeath all and singular the said stock in trade and the said property and the said profits unto my children share and share alike, children of a deceased child take their deceased parents share. I will and declare that my said wife shall not be answerable for any issues which may occur by reason of her carrying on the said business. In the event of my wife at any time deciding not to carry on the said business I will and direct that all the said stock in trade and utensils of the said business shall be realised and the proceeds thereof invested or deposited in The Newfoundland Savings Bank or some other Bank or Banks doing business in the Colony, or in Newfoundland debentures, or in bonds of the Dominion of Canada, and that my wife shall receive the annual interest arising therefrom for her own use during her lifetime, and that after her death the sum so invested or deposited shall be divided amongst my six children share and share alike, children of a deceased child to take their deceased parents share.

THIS is a codicil to the Last Will and Testament of me, Francis Noseworthy of Clarkes Beach in the Island of Newfoundland, Trader.

  1. I hereby revoke the bequest to my brother Jonathan Noseworthy of my interest in the Marine Desk at Harbour Grace, and I direct that my said interest in the said Marine Deck shall form port of the residue of my estate, and be disposed of in accordance with the provisions of my will dealing with the residue of my said estate.
  2. In all other respects I confirm my said last will and testament.

Dated at St. John's Newfoundland this 4th day of July A.D. 1928
