Will of Charles Nichols from Newfoundland will books volume 5 pages 140 -141 probate year 1887

Last will and Testament of
Charles Nichols of Harbour
Grace Ships Carpenter.

In the name of God Amen.

I Charles Nichols of Harbor Grace in the Island of Newfoundland Ships Carpenter being in good bodily health and of sound disposing mind memory and recollection being desirous of settling my worldly affairs while I have strength and capacity to do so do make publish and declare this my last will and Testament hereby revoking and making null and void all other last wills and Testaments by me heretofore made.

  • 1st I will devise bequeath and give to my son Thomas Nichols the land and house now occupied by him situate on Water Street for ever.
  • 2nd I will devise bequeath and give to my son Thomas Nichols the house erections and gardens attached now in my occupancy for ever.
  • 3rd I will devise bequeath and give all my right title interest and claim to the undivided land situate south side water street to my sons Thomas Nichols and Moses Nichols share and share alike for ever.
  • 4th I will devise bequeath and give to my son Moses Nichols the land and house now occupied by him for ever.
  • 5th I will devise beneath and give to my son Thomas Nichols the two gardens situate West Stanley Road and bounded on the west by John Knight, on the East partly by John Davis and on the North by Harvey Street for.
  • 6. I will devise bequeath and give to my son Thomas Nichols the western half of the garden Northward of Harvey Street bounded west by Jenkins and on the East by Samson Cove Brook for ever and the eastern half of the said garden I will devise bequeath and give to my son Moses Nichols for ever.
  • 7th I will devise bequeath and give to my son Moses Nichols the western two third part of the garden bounded east by my brother Thomas Nichols land and the eastern (1/3) one third of the said garden to my son Thomas Nichols for ever.
  • 8. I will devise bequeath and give to my daughter Selina Nichols wife of Charles ??? of Bryants Cove for her sole use and behoof one eighth part of the money in the Harbor Grace Branch Savings Bank to be paid to her three months after my decease.
  • 9th. I will devise bequeath and give to my sons Thomas Nichols and Moses Nichols seven eighths of the money at the time of my decease deposited in the Harbor Grace Branch Savings Bank.
  • 10th I will devise bequeath and give to my sons Thomas Nichols all my household goods and furniture
  • 11. I will devise bequeath and give to my sons Thomas Nichols and Moses Nichols the rest and residue of my estate of whatever kind or wherever situate for ever.
  • 12. It is my will wish and desire that my sons Thomas Nichols and Moses Nichols, should my son Stephen Nichols return to Harbor Grace that they pay him the sum of four dollars.
  • 13. I hereby nominate and appoint my sons Thomas Nichols and Moses Nichols to be the executors of this my last will and testament.

In testimony whereof I the said Charles Nichols hereunto set my hand and seal and publish and declare this to be my last will and testament in the presence of the witnesses named below this twentieth day of January in the year of our Lord eighteen hundred and eighty six - Charles his x mark Nichols (LS)
Signed sealed published and declared by the said Charles Nichols as and for his last will and Testament in the presence of us who in his presence and in the presence of each other and at his request have subscribed our names as witnesses hereto.
