This name is spelled Nevill and Neville in the will, and Neville
in the will index.
Last Will and Testament of
James Nevill of Topsail Road
Farmer deceased.
This is the last will and Testament of me James
Neville at present of the Topsail Road near Beaconsfield in the Island
of Newfoundland Farmer made this 18th day of July A.D. one thousand nine hundred.
I give devise and bequeath unto my wife for her sole use and benefit and the
support maintenance and education of her children during her life all those
several farms situate on the Topsail Road aforesaid and at present occupied
tilled worked and grazed by me. And on the death of my said wife I give devise
and bequeath the said farm lands and all the dwellings and barns thereon and
household furniture and farm stock as follows. I give devise and
bequeath two acres of land to each of my daughters Mary, Hannah and
Annie to
be measured off by my executor for them out of the farm on which I reside and
in stops or lots running from the Topsail Road down to the Waterford Bridge
Road. To hold the same to my said daughters for ever. The Balance of the said
farm after the said lots or strips have been taken for my said daughters together
with the upper farm and the land opposite Beaconsfield and all the dwelling
houses and stock on my said farms and all my furniture I give devise and bequeath
to my two sons James and George to be equally divided - between them To have
and to hold the same to my said sons for ever.
Notwithstanding anything
in the foregoing will I hereby authorize my said wife in the event of her considering
it necessary during her lifetime in the interest of the education and maintenance
of my said children or for the purpose of paying off the mortgages on the said
farms to sell and dispose of the said farms or any part thereof and the sums
realized for the same to apply to the purposes aforesaid. I hereby cancel and
annul all all former wills by me at any time made. I appoint Edward
P. Morris Queens Counsel Executor of this my will.
In witness whereof I have
hereunto subscribed my name by affixing my mark at Topsail Road aforesaid the
day and date first before written (sgd) James his x mark Neville. Signed published
and declared by the said Testator as and for his last will and Testament in
the presence of us who in his presence at his request and in the presence of
each other have hereunto subscribed our names as witnesses the same having
been first read over and explained (sgd) E. P. Morris. (Sgd) John
Channing.
I certify the foregoing to be a correct
copy of the last will and Testament of James Neville deceased
