Last Will and Testament of
Patrick J. Murphy of Whitbourne
Hotel Proprietor deceased.

      In the name of God Amen I Patrick J. Murphy of Whitbourne, Hotel Keeper make this my last will and testament hereby revoking all other and former wills by me at any time hitherto made. I give devise and bequeath to my executors hereinafter named for the purposes herein directed all the lands houses monies goods and chattels credits and effects of which I shall die possessed or entitled to and all monies which shall become payable under my life Insurances.

First to apply my monies and the proceeds of my Life Insurances to the payment of all my lawful, personal and business debts my funeral and testamentary expenses.

Secondly. To hold in trust for my beloved wife Rebecca the Hotel in which I now live, the lands on which it is erected and all lands shops stores houses and outhouses appurtenant thereto all my stock in trade and book debts and the good will of my business to be taken held and applied to and for her separate use for ever subject however to this condition namely that if my brother Joseph Murphy choose to purchase as I desire and wish him to do, the said hotel lands shops houses outhouses and premises goods and chattels stock in trade and good will within one year from the day of my decease and pay to my executors therefor the sum of three thousand dollars the hotel lands and other property described in this paragraph shall be sold and assigned to him and the said sum of three thousand dollars subject to any lawful deductions by my executors shall be paid to and accepted by my said beloved wife Rebecca Murphy in full satisfaction and release of this and the next following bequest

Thirdly. All my household goods and furniture, beds, bedding goods and chattels are to be held for my wife subject to transfer to my said brother Joseph Murphy on payment of the above named three thousand dollars. Save and except my beds bedding carpets furniture pictures & other articles of my bedroom and the organ carpets furniture pictures and articles of the drawing room all of which shall be retained by my said beloved wife Rebecca. All my horses cows sheep and farm stock shall be held and applied in like manner and in like manner transferred as is provided in this third bequest respecting household goods.

Fourthly To assign to my said beloved wife Rebecca unconditionally and for her sole and separate use my land and house now in the occupancy of my brother in law James Kennedy at Whitbourne -

Fifthly To assign for ever to my brother Peter Murphy the land and house at Whitbourne now occupied by him as my tenant and another piece of land adjacent thereto also used by him.

Sixthly To assign for ever to my beloved brother Joseph all my other lands and houses at Whitbourne not previously herein disposed of.

Seventhly. The balance of my monies and Life Insurance shall be applied as follows namely one hundred dollars to a priest of the Holy Roman Catholic Church whom I have named to one of my executors with my request that he will offer up the "Holy Sacrifice of the Mass" for the repose of my soul. Fifty dollars to my mother Murphy if living and if not then to my brother John Murphy: fifty dollars to my brother Peters two boys between them and the balance if any to my beloved wife Rebecca Murphy.

In case my said brother Joseph shall make the purchase contemplated it is my will and desire that my said beloved wife shall not be obliged to leave the hotel within six months of my decease but shall have the right to reside and be supported there without charge. It is further my wish and desire that my brother Joseph in order to harmonize and assist matters shall be aiding in the conduct of the business and collection of debts pending the purchase contemplated subject however to my executors.

I appoint P.J. Scott and J. D. Ryan of St. John's Executors of this will. (Sgd) P. J. Murphy. Signed and declared as and for his last will and Testament by the testator Patrick J. Murphy in presence of us who in presence of each other and of the testator and at his request sign as attesting witnesses - (sgd) John March. (Sgd) P. J. Scott
