Will of Benjamin Murphy from Newfoundland will books volume 5 page 676-677 probate year 1892

Last will and testament of
Benjamin Murphy of St. John's
Cooper deceased
.

In the name of God Amen

I Benjamin Murphy of St. John's in the Island of Newfoundland Cooper do make publish and declare this to be my last will and testament. First I direct that all my just debts shall be paid. Second. I give devise and bequeath unto my nephew Benjamin Murphy the house he now lives in and the piece of ground to the south west of the said house, the said piece of ground to be the width of the said house and to extend south west to Hanergans fence, the foregoing bequests are upon the express condition that my said nephew Benjamin permits his sister Margaret to live with him as long as she remains unmarried. I also give and bequeath unto my said nephew Benjamin Murphy a passage way of eight feet to the north west of said house. Third I give and bequeath unto my nephew Patrick Murphy the piece of ground to the south of the aforesaid house and bounded on the south by Lawrence Ryans land, on the south west by Hanergans land and on the north east by Patrick's Street. Fourth. I give and bequeath my household furniture beds etc for the use of my said nephew Benjamin and his sister Margaret as long as she remains unmarried : and in case of her marriage then the said household furniture beds etc are to become the property of my said nephew Benjamin. Fifth I give and bequeath unto my said nephew Benjamin all money and other property (not hereinbefore bequeathed) that I may be possessed of or entitled to at the time of my death. Sixth I hereby nominate and appoint James Brennan of St. John's Publican and James Shortall of same place Cooper executors of this my will. Lastly I annul all former wills by me made or executed. In witness whereof I have hereunto my hand and seal subscribed and set at St. John's aforesaid this Sixth day of March A.D. 1877. (Sgd) Benjamin his x mark Murphy Signed by affixing his mark sealed and declared by the said Benjamin Murphy as and for his last will and testament in our presence and in presence of each other and who have at his request subscribed our names as witnesses being first read over and explained. (Sgd) M. J. O'Mara. (Sgd) Donald Morison.
I certify the foregoing to be a correct copy of the last will and testament of Benjamin Murphy deceased.
