Will of Benjamin J. Murphy

In re
      BENJAMIN MURPHY.     DECEASED.

I, Benjamin Murphy, of Saint John’s, Cooper do hereby revoke all former Wills, by me made, and declare this to be my last Will.

FIRST. I bequeath unto my son Francis J. Murphy, the double tenement house and land, situated on the west side of Patrick Street, and known as house NO. 7 and 9 and that the said Francis J. Murphy shall have all appurtenances to said house and land, and I do further bequeath unto my son Francis J. Murphy, the 18Ft of land extending west and the width of said House, to within 5 ½ Ft of my Coopers Shop with the right to the use of Passageway to the north west of said house and land the said passageway to measure 3 ½ Ft in width and extending west to within 5 ½ Ft of my Coopers shop the same being the north west boundary point of said house. The conditions on which I bequeath the above named house and land with right of way thereto are that my son Francis J. Murphy shall not at anytime sell or cause to be sold the said house, land, or right of way thereto without the consent of his sister Mrs. Elizabeth Skinner and two Executors to be named by me in this my last Will.

      I also bequeath unto my son Francis J. Murphy all my shares and interest in the Newfoundland Victory Bonds if any at my death, and in the event of my sons death, the said shares and interest are to be taken by my daughter Mrs Elizabeth Skinner to do as she wish with.

SECOND. I bequeath unto my daughter Mrs. Elizabeth Skinner the house and land, known as house NO. II. Patrick Street with all right of way to said house and land. I also bequeath unto my daughter Mrs. Elizabeth Skinner all that vacant piece of land extending west of said house NO. II. Patrick Street to fence of land known as Murphy’s, and to the north west end of my Coopers Shop and that the frontage of said vacant land shall measure 19 ½ Ft from house and land, known as Connolly’s, and shall extend south to Passageway or to a point 3 ½ Ft from house and land known as house NO. 7 and 9 west to the north east end of my Coopers Shop. I also bequeath unto my daughter Mrs. Elizabeth Skinner all my shares and interest in the St. George’s Coal Mines of Newfoundland for her own use and benefit.

THIRD. I bequeath unto my son in law Henry Skinner my Coopers shop and land the boundary lines of said Coopers shop and land to extend south to Coopers Shop of the late Peter Murphy and east 5 ½ Ft to boundary line of house and land known as house NO. 7 and 9, and, to the south west boundary of vacant land and house known as NO. II. Patrick Street and that the said Henry Skinner shall have the right of way of passageway to and from said Coopers shop and land. I also bequeath unto my son in law Henry Skinner all my Coopers tools for his own use and benefit, and if at my death there be any stock in my Coopers Shop I trust my son in law Henry Skinner will use it to the best possible advantage for my children that are mostly in need or want.

FOURTH. I bequeath unto the R.C. Church, the sum of $50. Fifty Dollars for the purpose of prayers and masses for my soul and for the souls of my wife and uncle Benjamin Murphy, and I do further direct that any money I may possess at my death shall after the expenses I may have incurred, and all my Funeral Expenses are paid, shall be divided, in the following manner, that is to say, I bequeath unto my daughter Mrs. Angus Snow 1/8 one eight of all such money that I may at my death possess and unto my daughters Mrs Catherine Parsons, and Mrs. Louise Cushman, and Mrs Mary Patrick Carley. I direct that the remainder of all such money shall be equally divided.

FIFTH. In making this my last will, I direct and appoint as my two Executors Mr. Frederick Callahan of Saint John’s Grocer, and Mr. Thomas J. Freeman of Saint John’s, Mining Promoter the said two Executors, having at my request consented to act, as Executors to my Will. Trusting that the bequeaths I have in this my last Will be satisfactory to all concerned, and that the Executors I have herein named will see that the bequeaths as herein directed by me in this my last Will by me made are carried out.
