Last will and Testament of
Andrew Murphy of Brigus ND.
Fisherman deceased
The last will and Testament
of Andrew Murphy of Brigus Conception Bay in the Island of Newfoundland.
In the name of God Amen. I Andrew Murphy being weak
and feeble of body but of sound mind and memory do make and publish this
my last will and Testament in manner and form following that is to say:-
First. I give and bequeath unto my beloved wife Rhoda Murphy all
the land and property I have at present under fence with all and singular
the rights privileges and appurtenances thereof to be held occupied and
possessed by her without control for and during the full term of her
natural life and for the support and maintenance of my four youngest
children and after her decease my will is that the said land and property
shall go to which ever of the said children as shall have contributed
most to her assistance and helped her in her advanced years and paid
the expenses attending her last illness, wake and funeral, and it will
be for her say and decide between them and on no account is any of the
said land to be sold or disposed of during the lifetime of my said wife.
Second. In the event of my brother Patrick Murphy dying without heirs
I give and bequeath the old garden now occupied by him to my son Andrew
Murphy but on the condition that the widow of my said brother Patrick is not to be disturbed in the occupation of it while she remains in the
name of Murphy but after her decease or second marriage, in the event
of the death of my said brother, it is to become the property of my said
son Andrew.
Thirdly. I give and bequeath my horse and
cow and all the rest and residue of my personal estate and property of
what kind so ever the same may be unto my said wife Rhoda Murphy and
for her use and benefit for and during the term of her natural life.
And I do hereby nominate and appoint my said wife as sole Executrix to
this my last will and Testament. In witness whereof I have hereunto my
hand and seal subscribed and set this sixth day of July in the year of
our Lord one thousand eight hundred and eighty six. (Sgd) Andrew

Murphy the testator
in our presence and we at the same time at his request and in his presence
and in presence of each other subscribe our names as attesting witnesses
thereto. (Sgd) Jas. Tarahan J.P. (Sgd) Patk.

Codicil
On the same day and date as the foregoing I Andrew Murphy do hereby
add the following condition as a codicil that my said wife shall
pay unto the very Rev. E. G. Walsh P.P. the sum of four dollars
out of my said estate for the purpose of saying masses for my soul. Witness
my hand the day and date before written. (Sgd) Andrew his
X mark Murphy. Witnesses to the foregoing codicil (sgd) Jas.
Tarahan J.P. (Sgd)

the foregoing to be a correct copy of the last will and Testament & codicil
of Andrew Murphy deceased
