Will of Matthew Morris In re In the name of God Amen, On the seventh day of June one thousand eight hundred and forty three, I Matthew Morris of Saint John's in the Island of Newfoundland Farmer being sick and weak of body but of perfect mind and memory thanks be given unto God, therefore calling unto mind the mortality of the body knowing that it is appointed unto all men once to die do make and ordain this my last will and testament that is to say, principally and first of all I give and recommend my soul into the hands of Almighty God that gave it and my body I recommend to the earth to be buried in decent Christian burial at the discretion of my executors nothing doubting but at the general resurrection I shall receive the same again by the almighty power of God and as touching such worldly estate wherewith it hath pleased God to bless me in this life I give demise and dispose of the same in the following form and manner first to my son Edward Morris I give and bequeath one shilling, to my daughter Mary Ryan one shilling to my daughter Ann Angel one shilling to my daughter Julianne Brocklehurst one shilling to my son Matthew Morris one shilling to be levied out of my estate and paid by my executors hereafter named to my son Luke Morris to my son Geoffrey Morris to my son Thomas Morris and to my son John Morris I give and bequeath two fishing rooms at Brigus by South occupied and rented from me by John Power and Dennis Pendergast to be divided as follows, to the aforesaid Luke Morris one fourth part to the aforesaid Geoffrey Morris one fourth part to the aforesaid Thomas Morris one fourth part and to the aforesaid John Morris one fourth part their executors administrators and assigns for ever equally to have and enjoy hold and possess one fourth each of all profits rents or incomes arising from the aforesaid fishing rooms at Brigus by South now occupied under me by John Power and Dennis Pendergast and after the agreements expire by which my tenants John Power and Dennis Pendergast hold under me the aforesaid Rooms they are to deliver them up according to agreement unto Matthew Morris the younger and Charles Brocklehurst whom I now do appoint my sole executors The aforesaid rooms not to be leased rented or otherwise disposed of without the mutual consent of the aforesaid Luke Morris, Geoffrey Morris, Thomas Morris and John Morris, no transfer mortgage or lease of any description to be legal unless made to one of the family. The rents of the aforesaid Rooms at Brigus for the years eighteen hundred and forty three and eighteen hundred and forty four to be paid unto one of my executors ever afterwards for the benefit of the aforesaid Luke Morris, Geoffrey Morris, Thomas Morris and John Morris. And I do hereby utterly disallow, revoke and disannul all and every other former testaments, wills, legacies, bequests or executors by me in any ways before named willed and bequeathed ratifying and confirming this and no other to be my last will and testament Certified correct,

Note: The wills in those will books are NOT actual wills. They are either hand-written copies or in later years typed copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor. We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be. |
