Will of William Mills
from Newfoundland will books volume 13 pages 21-22 probate year 1924

In re
      WILLIAM MILLS.     DECEASED.

I William Mills of Shoal Harbour in the District of Trinity Newfoundland, Merchant (known as Wm Mills & Sons) Being of sound and disposing mind and memory, Do make and publish this my Last Will and Testament, hereby revoking all former Wills by me at any time heretofore made.

1st. I give devise and bequeath to my beloved wife Katherine my dwelling house at Shoal harbour with the lot on which it is erected also Out house Furniture and chattles contained therein, to hold the same to her as long as she remains my Widow and properly takes good care of my two sons John and Lawrence and remains with them in said dwelling, and after her decease or at such time as she should discontinue to take care of my two sons John and Lawrence or should leave said dwelling for a long period or should marry the said dwelling out house, furniture chattle Etc to go to my two sons John and Lawrence share and share alike, except one Parlour Suite (5 Pieces) which I give devise and bequeath to my beloved wife Katherine as her own forever.
2nd. I also devise and bequeath to my said wife (as long as she remains my Widow and remains in said dwelling taking of my said sons) and my said sons balance due at the end of each month from the firm of Wm Mills & Sons same to be divided between them share and share alike the gardian of my two sons to control their shares, same payable at end of each month also my for my wife to be provided for by the firm of Wm Mills & Sons as long as she remains my Widow and remains in said dwelling taking care of my two sons, the management of my said dwelling to be governed by the guardian of my said two sons.
3rd. I give devise and bequeath to my four sons namely Leander Chesley John and Lawrence the following Shop Stores Mill Schooner Mary Motor Boat and all property connected with the Business of William Mills & Sons also Barn Cattle Farm Emplements Etc, their heirs and assigns forever the guardian of my two sons John and Lawrence to look after their shares until they become of age.
4th. I also give to my two sons John and Lawrence the sum of about One hundred and fifty now deposited in my name in The Canadian Bank of Commerce at St John’s their guardian to control same.
5th. I also give and bequeath to my son Leander the following land included on my grant bounded on the East by public Road and on the South by my own land and on the West by Crown land and on the North by vacant land, extending two and seventy three feet more or less on the East and extending North West to the end of my granted land, to be his and his heirs and assigns forever.
6th. I also Give devise and bequeath to my son Lawrence the following lands, all that lot now under cultivation, Bounded North by granted land and on the South by by Rail Road and on the East by private road leading to stores and on West by Salt water, to be his his heirs and assigns forever, Same to be attended to by his guardian.
7th. I also give devise and bequeath to my sons John and Lawrence the balance of my granted land West of Public Road except that given to my sons Leander and Chesley same to be divided between them share and share alike (and attended to by their guardian) to be theirs and their heirs and assigns forever.
8th. I also give devise and bequeath to my son Chesley the following lands - all that lot of land now under cultivation bounded on the North by private road leading to my Stores and on the South by Rail Road and on the East by Ivanys land and on the West by salt water, also all lands on which his own dwelling and outhouses etc is erected and all within his own fence, to be his heirs and assigns forever.
9th. I also bequeath all lands on which shop stores etc is erected in connection with the business of Wm Mills & Sons also private Roads and walks to my four sons as aforesaid each to free excess to same.
10th. I do hereby nominate my two sons Leander and Chesley to be the executors of this my last will and testament, and do hereby nominate my son Leander to be the guardian of my two sons John and Lawrence.
In witness whereof I have hereunto set my hand and seal this seventeenth day of March in the year of Our Lord One thousand nine hundred and twenty four.     Signed WM MILLS.
Signed published and declared by the said William Mills the testator, as and for his last Will and Testament in the presence of us both present together at the same and in his presence at his request, and in the presence of each other, have hereunto subscribed our names as witness to the due execution thereof.
