Will of Elizabeth Mercer from Newfoundland will books volume 14 pages 368-369 probate year 1928

In re       DECEASED.
      ELIZABETH MERCER.

I, Elizabeth Mercer of St. John's Newfoundland, widow hereby make and publish my last will and testament and revoke all former wills by me made. I appoint and nominate Staff Captain Rhoda Lacey Sainsbury sole executrix of this my last will. I first direct that all my estate of every description and wheresoever situate be sold and I further direct that out of the proceeds my executor pay the sum of one hundred dollars to "The Cook Street Anchorage" as a bequest first having paid all my just debts funeral and testamentary expenses and erected a headstone to my memory The residue of my said estate I give and bequeath to my children living at the time of my death in equal shares. In witness whereof I have hereunto subscribed my hand to this my last will at St. John's aforesaid this 17th day of November 1927 by making my mark this having been first read over and explained to me

Signed by the testatrix as and for her last will in our presence in her presence and in the presence of each other have hereunto subscribed our names as witnesses this will being first read over to the testatrix and explained to her who appeared to understand the same perfectly.

This is a Codicil to my foregoing will. Instead of my direction that the residue of my estate be divided equally among my children living at the time of my death I hereby direct that the sums of one hundred dollars each be given my daughters living at the time of my death and the residue of my estate be divided equally among my sons living at the time of my death and if only one son be so living then all the residue goes to him. The foregoing expressions "my sons" "only one son" shall include and mean not only my lawful sons but also my adopted son Arthur. With the exception of this Codicil my said will if hereby confirmed. In witness whereof I have hereunto subscribed and set my hand to, this a codicil to my said will this 29th day of August 1928 at St. John's Newfoundland by making my mark the foregoing having been first read over and explained to me.
