Last will and Testament
of Charles Mercer
of Bay Roberts Planter Deceased
.

In the name of God. Amen. I Charles Mercer of Bay Roberts, Conception Bay, Newfoundland Planter being of sound mind and memory do on this 24th day of July in the year of our Lord one thousand eight hundred and eighty two, make this my last will and testament; I give to my eldest son, Esau Mercer, for the term of his natural life, the dwelling houses at present rented to Wm. Buckland situate on the north side of the main road leading through Bay Roberts, and at his death I will that it be the property of his eldest son. I also will to my son Robert Mercer, for the term of his natural life, the house situate on the south side of the main road running through Bay Roberts at present rented to Mr. Murphy and at his death I will that it be the property of my eldest son. I will also that all my land situate at Spaniards Bay Pond, and at Birch hill be equally divided between my two said sons Esau and Robert and that it be held by them on the same terms as the aforesaid houses are held in that they have a life interest in it, with no power to sell or mortgage, or otherwise divert it and at their deaths that it pass into the hands and become the property of their eldest sons. And further, seeing that the house which I have willed to my son Esau is on land willed to my son Robert. I will that if Robert be unwilling that it should remain there, Esau remove it within six months after written notice to do so has been given him
Charles his x mark Mercer. Signed sealed and delivered by the said Charles Mercer on twenty fourth of July in our presence and in the presence of each other in the year of our Lord one thousand eight hundred and eighty two witness Robert Simpson W. C. Earle.
I certify the foregoing to be a correct copy of the last will and Testament of Charles Mercer.
