(The will index gives the probate year, for this will, as 1868, but it is filed chronologically with wills from 1886)

In re
      Michael Meehan deceased.

This is the last will and testament of me Michael Meehan of St. John’s in the Island of Newfoundland, Tailor, after payment of my just debts and funeral expenses. I give devise and bequeath unto my son John F. Meehan all the landed and other property of what nature or kind soever comprising land and tenements in Water Street, and in Torbay, or any other property of which I may die possessed To have and to Hold the same and every part thereof unto the said John F. Meehan his executors and administrators for ever Upon trust nevertheless to pay and appropriate the rents issues and profits thereof (after paying the interest due on the encumbrances on said property to and for the use support and maintenance of Ellen Meehan widow of my son William B. Meehan during her natural life should she remain a widow and unmarried and to and for the use support and maintenance of Francis John Meehan and Charles Edward Meehan or the survivor of them until they or the survivor of them shall attain the age of twenty one years.    I further will and direct that in the event of the death or second marriage of the said Ellen Meehan (widow of the said William B. Meehan) and the said Francis John Meehan and Charles Edward Meehan children as aforesaid attaining respectively the age of twenty one years, or both of them dying before that age, then upon the further trust to pay and appropriate the rents issues and profits aforesaid to and amongst such of my own children including the said John F. Meehan as may be then living share and share alike.    I hereby nominate and appoint my son John F. Meehan trustee as aforesaid, executor of this my last will and testament. Dated at St. John’s aforesaid this thirty-first day of January Anno Domini one thousand eight hundred and sixty four-    Michael his X mark Meehan.    Signed and delivered by the said Michael Meehan as & for his last will and testament in the presence of us who in the presence of each other and in the presence of the said M. Meehan and at his request have subscribed our names as witnesses, Witnesses presence to the signature of the within named Michael Meehan, Thos. J. Kough, Eliza Allen.

Note: The wills in those will books are NOT actual wills. They are either hand-written copies or in later years typed copies of a, "last will and testament," written or typed by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation and also no paragraphs. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be. However, in some of the very long wills, we have tried to insert paragraphs to make it easier for the researcher to read the document.
