Will of Patrick McGrath
from Newfoundland will books volume 12 pages 541-542 probate year 1924

In re
      PATRICK MCGRATH.          DECEASED.

This is the last Will and Testament of me Patrick McGrath, of St. John’s, Newfoundland, Cooper.

  1. I appoint my brothers, John, Thomas and Leo McGrath of St. John’s, to be the executors of this my last Will and Testament.

  2. I leave to my said executors all property, real and personal, whereof I may die possessed, IN TRUST for the benefit of my wife Hannah McGrath and my four children: Kenneth Patrick McGrath, Annie McGrath, John McGrath and Thomas McGrath.

  3. I direct that my executors shall manage and invest my said property at the best rate of interest which can safely be obtained and pay over the interest thereupon to my said wife so long as she shall live and remain unmarried, provided always that she shall provide a home for such of the children as are unable fully to support themselves. In the event of the said interest not being reasonably sufficient for the maintenance of my said wife and dependents, I authorise my executors to expend from time to time in addition to the interest, such portion of the capital as they may deem necessary.

  4. In case of the death or re-marriage of my said wife or her refusal to provide a home for dependent children as aforesaid, the said executors shall hold the remainder of the capital in trust for my said children, and pay over the interest to them in such shares as my said executors may deem proportioned to their respective needs, until such time as the youngest of them shall have attained the age of twenty-one years, when the remainder of the capital shall be equally divided among them.    PATRICK MCGRATH.

Signed and declared by the said testator as and for his last will and testament in the presence of us who in his presence and in the presence of each other did sign our names as subscribing witnesses thereto.
