Will of Elizabeth McGrath
In the name of God Amen. This is the last will and testament of Elizabeth McGrath widow of the late Thomas McGrath deceased. After the payment of all my just debts funeral and testamentary expenses I will and bequeath unto my daughters Catherine, Anne and Ellen all my right title and interest in and to all lands houses moneys rents goods chattels and effects which I am now possessed of or entitled to, either in my own right as the widow of the late Thomas McGrath or as his adminstratrix to have and to hold the same unto my said daughters Catherine, Anne and Ellen to their sole and absolute use and benefit as tenants in common share and share alike free and clear of the control of any person whatsoever. I hereby nominate and appoint James Callanan and Patrick Coonan of Saint John’s executors of this my last will and testament revoking and annulling all other and former wills made by me, 6th day of September 1867
Elizabeth her X mark McGrath (LS) Signed sealed and declared as and for the last will and testament of the said Elizabeth McGrath in our presence the same having been first read over to and approved of by the testatrix and executed by her in our presence, Jos. I. Little, James Callanan.
Note: The wills in those will books are NOT actual wills. They are either hand-written copies or in later years typed copies of a, "last will and testament," written or typed by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.
We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
