Will of Denis McCarthy
from Newfoundland will books volume 2 page 286-287 probate year 1858.
(This name is spelled Denis and Dennis, McCarthy and McCarty in the will and Denis McCarthy in the will index.)

In re
     Denis McCarthy      deceased.

In the name of God Amen.     I Dennis McCarty of Saint John's Newfoundland, Fisherman, feeling myself very delicate in health and knowing that it is appointed for all men once to die, being now of perfect sound and disposing mind memory and understanding, thanks be given unto God, do make and ordain this to be my last will and testament in manner following, First and principally of all I give and recommend my soul into the hands of Almighty God that gave it and my body to the earth to be decently interred,-
And as touching such worldly estate wherewith God has blessed me with in this life I give and bequeath the same as follows, I desire and request that my funeral expenses may be paid and discharged as soon as possible after my interment     I fished last summer on Mr. Larmeurs Room on Grady Harbour Labrador and I give and bequeath the balance in full now due to me from Mr. Larmeur aforesaid to Edward Norris that I now live with, and also the amount in full now due to me by Messrs. Hunters & Col of St. John's Merchants. Also my bed and bedding, two guns and all other property of whatever nature or kind soever unto and to the use and benefit of the said Edward Norris.
About ten or twelve years ago I deposited the sum of fifteen pounds in the Savings Bank of St. John's and I have not since drawn any of the said principal or interest arising therefrom, and I give and bequeath the same as follows that is to say, the sum of five pounds thereof to the Right Revd Doctor Mullock and praying that His Lordship may be pleased to offer up one High Mass and office for my soul and the remainder or balance then remaining in the Bank I give and bequeath to the Reverend Father O'Donnell of St. John's.     And I nominate and appoint Thomas Brawders and the above named Edward Norris executors of this my will and I hereby declare null and void all wills legacies and bequests heretofore made by me, declaring this and no other to be my last will and testament
In witness whereof I have hereunto set my hand and seal at St. John's this twenty fifth day of January in the year of our Lord one thousand eight hundred and fifty eight.

Note: The wills in those will books are NOT actual wills. They are either hand-written copies or in later years typed copies of a, "last will and testament," written or typed by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
