Will of Edward Martin
from Newfoundland will books volume 8 pages 89 & 90 probate year 1906.

In the Estate of
     Edward Martin       deceased.

This is the last will and Testament of me Edward Martin of White Hills near Saint John's in the Island of Newfoundland, Farmer I direct that all my just debts funeral and testamentary expenses shall be first paid out of my estate. I appoint my wife Sarah Jane Martin the Executrix of this my last will and Testament. I give and bequeath unto my said wife Sarah Jane Martin all my household furniture of every description absolutely. I give and bequeath unto my said wife Sarah Jane Martin for and during the term of her natural life all other property of every description both real and personal of which I may die possessed and after her death to be divided amongst my children as follows and upon the following conditions namely:
To my son William Alexander the piece or parcel of land containing about twelve acres with the dwelling house stables and barns thereto belonging Provided that he the said William Alexander shall pay to my three daughters Annie Moore, Elizabeth Hannah Hill and Elsie the sum of one hundred dollars each in the manner following; to my daughter Annie Moore he the said William Alexander shall pay the sum of fifty dollars within one year and the remaining sum of fifty dollars within two years of the decease of my said wife Sarah Jane Martin; to my daughter Elizabeth Hannah Hill he the said William Alexander shall pay the aum of fifty dollars within three years and the remaining sum of Fifty dollars with four years of the decease of my said wife Sarah Jane Martin and to my daughter Elsie he the said William Alexander shall pay the sum of fifty dollars within five years and the remaining sum of fifty dollars with six years of the decease of my said wife Sarah Jane Martin.
To my son Herbert Edward my piece of cultivated land to the North of the river and containing about eight acres. Provided that he will pay to my son Thomas Henry the sum of two hundred dollars in the manner following: the sum of fifty dollars within one year and the remaining sum of one hundred and fifty dollars within four years of the decease of my said wife Sarah Jane Martin. I give unto my said wife Sarah Jane Martin all my horses cows stock carts carriages sleds and farming implements of every description absolutely.
In witness whereof I the said Edward Martin have hereunto subscribed my name this nineteenth day of September Anno Domini one thousand nine hundred and six. Edward Martin.
Signed published and declared by the said Testator as and for his last will and Testament in the presence of us, who, at his request in his presence and in the presence of each other have subscribed our names as witnesses Charles H. Emerson   Frank D. Lilly

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
