In re
      NATHANIEL MARCH       deceased.

      This is the last will of me Nathaniel March of St. John’s Newfoundland, Merchant, and I revoke all former wills by me made.    I appoint Honourable Henry J. B. Woods, Frederick W. Ayre, of St. John’s, Merchant, and John Wesley March (my Son) hereinafter called “my trustees” to be the executors and trustees of this my will.    I devise and bequeath all my property of whatsoever kind that I die possessed of to my trustees Upon Trust that my trustees shall sell, call in and convert into money the same or such part as shall not consist of money and after paying all my just debts, funeral and testamentary expenses shall in their discretion invest the balance of the proceeds hereinafter called the “Trust funds” and shall stand possessed of the said trust funds and the investments for the time representing the same in Trust to pay the net income arising from such trust funds in equal shares for ten years from the last day of the year in which I shall die to my wife, my said son and my then (at date of payments of income) unmarried daughters or daughter or to such of them (my said wife, son and unmarried daughters or daughter) as are then (at date of payments of income) surviving And on the last day of the said ten years to pay, transfer or hand over to the then survivors of my wife, son and unmarried daughters or daughter in equal shares, the said trust funds together with such accrued income as may be not then paid over as aforesaid provided my trustees may at any time before the said last day of the said ten years pay transfer or hand over as aforesaid upon a written request signed by such of them (my said wife, son and unmarried daughters or daughter) as at the date of said request are then surviving. And if any part or all of the said property at the end of the said ten years be not then sold or converted my trustees on the written consent of the person or persons then entitled namely, the then survivors of my said wife, son and unmarried daughters or daughter, transfer or hand over same in specie in the manner the said person or persons may agree upon
And I also declare that my trustees may postpone the sale and conversion of any part of my property for so long as they shall think fit, but not to exceed eleven years unless as before provided for and that the rents, profits and income to accrue from and after my decease of and from such part of my estate as shall for the time being remain unsold and unconverted shall after payment thereout of all incidental expenses and outgoings be paid and applied to the person or persons and in the manner to whom and in which the income of the proceeds of such sale and conversion would for the time being be payable or applicable under this my will if such sale and conversion had been actually made And I also declare that the power of appointing new trustees conferred by statute shall for the purposes of this my will be vested during the continuance of the trust in the then (at the time of making such appointment) beneficiaries under this my will or a majority of them AND I also declare that while my said wife son and unmarried daughters all agree that my wife and family shall occupy my Circular Road residence then my trustees shall permit the same to be so occupied at an annual rental of two hundred dollars, and the cost of repairs, insurance, taxes and interest on mortgage (if any) shall be liquidated out of said rent and the net balance be paid over as hereinbefore provided for
AND I also declare that if any of my children advance any moneys for the purpose of paying any debts in connection with my estate or in the upkeep and maintenance of my said Residence the said moneys shall be paid back to him, her or them at the time of the distribution of my estate And I also declare that in construing this my will any daughter of mine while a widow shall be considered as an unmarried daughter.    In witness whereof I have set my hand to this my will the 11th day of August 1911.    Nathaniel March     Signed by the above named Nathaniel March as his last will (in two sheets each sheet being signed) in the presence of us, both being present at the same time, who in his presence and in the presence of each other have hereunto subscribed our names as witnesses Jas. J. McGrath     Robert Alsop.
