Will of Nathaniel March In re This is the last will of me Nathaniel
March of St. John’s Newfoundland, Merchant, and I revoke all
former wills by me made. I appoint Honourable Henry
J. B. Woods, Frederick W. Ayre, of St. John’s, Merchant, and John
Wesley March (my Son) hereinafter called “my trustees” to
be the executors and trustees of this my will. I devise and bequeath
all my property of whatsoever kind that I die possessed of to my trustees Upon
Trust that my trustees shall sell, call in and convert into money the same
or such part as shall not consist of money and after paying all my just debts,
funeral and testamentary expenses shall in their discretion invest the balance
of the proceeds hereinafter called the “Trust funds” and shall
stand possessed of the said trust funds and the investments for the time representing
the same in Trust to pay the net income arising from such trust funds in equal
shares for ten years from the last day of the year in which I shall die to
my wife, my said son and my then (at date of payments of income) unmarried
daughters or daughter or to such of them (my said wife, son and unmarried daughters
or daughter) as are then (at date of payments of income) surviving And on the
last day of the said ten years to pay, transfer or hand over to the then survivors
of my wife, son and unmarried daughters or daughter in equal shares, the said
trust funds together with such accrued income as may be not then paid over
as aforesaid provided my trustees may at any time before the said last day
of the said ten years pay transfer or hand over as aforesaid upon a written
request signed by such of them (my said wife, son and unmarried daughters or
daughter) as at the date of said request are then surviving. And if any part
or all of the said property at the end of the said ten years be not then sold
or converted my trustees on the written consent of the person or persons then
entitled namely, the then survivors of my said wife, son and unmarried daughters
or daughter, transfer or hand over same in specie in the manner the said person
