Will of Josiah Manuel
from Newfoundland will books volume 8 pages 211 to 213 probate year 1907

In re
      Josiah Manuel          deceased.

      This is the last will and testament of me Josiah Manuel of Exploits in the Electoral District of Twillingate, Merchant.
First: I hereby revoke all wills and testamentary dispositions by me at any time heretofore made and declare this to be my true last will and testament.
Second. I desire that all my just debts, funeral and testamentary expenses (save and except any debts which may be due in connection with my business which are hereinafter provided for) shall be first paid out of my estate by my executors hereinafter named.
Third    I appoint my son Jabez Manuel and my son-in-law John C. Crosbie Executors of this my will.
Fourth. I direct that my said Executors shall make provision for the payment to my wife Jane Elizabeth of such a sum as shall with the addition of the rent of the business premises at Exploits amount to three hundred dollars per annum, and I direct that said sum shall be paid to my wife yearly and every year during her natural life for her support and maintenance.
Fifth.    I direct that my said Executors shall permit my said wife to use and enjoy, for and during her natural life, all household goods, furniture and effects of every description which shall at the time of my death be contained in the dwelling house now occupied by me at Exploits.
Sixth. Upon the death of my said wife I give and bequeath the said household goods, furniture and effects to my son Chesley absolutely.
Seventh. I give devise and bequeath to my two sons Jabez and Chesley in equal shares the trade or business carried on by me at Exploits aforesaid, together with all stock in trade, implements, utensils, vessels, boats, fishing gear, goods, chattels and effects of every description belonging to or connected with the said business, and also all debts which shall be due to me in respect of or in connection with the said business at the time of my death subject to the condition that my said sons shall be liable for and shall pay and discharge all debts which shall be due by me at the time of my death in respect of or in connection with the said business.
Eighth. I bequeath to my said two sons Jabez and Chesley in equal shares all shares and stock of any Company or Companies of which I shall be possessed at the time of my death.
Ninth. I bequeath to my two daughters Jennette and Mitchie Ann in equal shares as tenants in common for ever all that piece or parcel of land situate on the East side of Victoria Street in Saint John’s together with the dwelling house and all other erections thereon held by me under conveyance from John C. Crosbie dated the 5th, day of June A.D. 1901.
Tenth. I bequeath to my said two daughters Jennette and Mitchie Ann the sum of one thousand dollars each.
Eleventh. All the rest, residue and remainder of my monies, goods, chattels, estate and effects of every description not hereinbefore specifically disposed of I hereby give and bequeath to my said four children, Jabez, Chesley, Jennette and Mitchie in equal shares. Witness my hand at Saint John’s this twenty-second day of December Anno Domini one thousand nine hundred and three Josiah Manuel signed published and Declared by the said testator as and for his last will and testament in our presence who in the presence of the testator and of each other, all present at the same time, have hereunto subscribed our names as witnesses    D Morison A.W.       This is a codicil to the last will and testament of me Josiah Manuel of Exploits in the Electoral District of Twillingate Merchant, said will having been executed by me on the twenty-second day of December one thousand nine hundred and three: -
First, I bequeath to my daughter Jennette the sum of one thousand dollars in addition to the sum of one thousand dollars already bequeathed to her in my said will.
Second. I bequeath to my three grandchildren, Jennette Manuel Crosbie, Nina Louise Mitchie Crosbie and Elizabeth Kera Crosbie the sum of one hundred dollars each.
Third, In all other respects I hereby confirm my said will as executed by me on said Twenty-second day of December one thousand nine hundred and three. Witness my hand at Saint John’s this sixth day of November Anno Domini one thousand nine hundred and five.    Josiah Manuel signed published and Declared by the said testator as and for a codicil to his said last will and testament in our presence who in the presence of the testator and of each other all present at the same time have hereunto subscribed our names as witnesses.    D Morison     A.W.
