Will of John Manuel from Newfoundland will books volume 5 pages 134-136 probate year 1887

Last will and Testament of
John Manuel of Catalina, Trinity
Bay Planter.

In the name of God Amen. I John Manuel Planter of Catalina in the District of Trinity Bay East being in poor health but of sound mind and memory do now make my last will and Testament. I will and bequeath to my son William Manuel all my houses craft nets Seins & land (except a piece of land and waterside as pointed out by me to my brother Thomas Manuel who will point out the same to my grandson Alex Manuel to be his or his heirs as long as he have an heir to possess it should he have no heir then it shall pass to William or his heirs should my son William Manuel die then all the houses land and other property belonging to the estate shall go to his heirs and pass from one heir to another heir as long as there is an heir to possess it. In no case can my son or grandson sell any portion of the land owned by me and willed to them except one heir sell to another.
I will and bequeath to my son Thomas Manuel's child should it live the sum of forty pounds £40.0.0 to be paid in yearly instalments at 3 p year until the said £40.0.0 is paid if the child do not live then the said £40.0.0 or what is left after its death shall be equally divided between my sons and daughters.
I will and bequeath to my brother Thomas Manuel the sum of five pounds £5.0.0
I will and bequeath to my son John Manuel or his son Alex my son William Manuel my daughter Ellen Perry my daughter Emily Mifflin my daughter Elizth Norman what money I have after my decease after deducting funeral expenses and the price of a head stone for me for each to have an equal share of said money all other articles belonging to me and not herein specified I will and bequeath to my son William Manuel or his heirs.
I now appoint my brother Thomas Manuel and my son William Manuel executors to my last will and Testament. - Signed this 30th day of May in the year of our Lord 1885. John his x mark Manuel

Signed by John Manuel Testator in our presence and we in his presence and in the presence of each other subscribe our names as witnesses. Caleb x Diamond Thomas x Manuel.

B. Codicil

I revoke the former stipulations that I have made for my grandson Alex Manuel in reference to land. I will and bequeath my grandson Alexander Manuel half of my fishing room the waterside to be divided by a line running through said Room S.W. & N.E. or thereabout and there is to be 12 feet left out of Williams part of said room to give access to Alex's part, the road to go by the eastern end of the cellar. - The said property to become Alexander's when he is the age of 17 years my son William and heirs to have use of said land until my grandson Alex is 17 years of age. Should my grandson Alex die before he is 17 years of age the said land is to be Wm. or his heirs or should he die and leave no heir the said land to be Wm. Or his heirs My grandson Alexander is to receive his part of money willed to him by me when he is the age of 17 years - in the event of him not living to the age of 17 years then his portion of said money will be divided between his sisters.- Witness my hand this 27 day of March A.D. 1886. - John x Manuel.
