Will of from Newfoundland will books

      This is the last will and Testament of me, Maurice Malone, of Carbonear, but at present of Saint John’s, Gentleman.
1. I appoint the Honourable James D. Ryan of Saint John’s, and Thomas Fitzgibbon of the same place, shopkeeper, executors of this my will.
2. My said Executors shall first pay all my debts (if any) and my funeral and testamentary expenses out of my Estate.
3 I give devise and bequeath to my said Executors all my property Estate and effects upon trust to pay the income thereof to my wife, Hannah Martha Malone, during her life: and after her death to distribute the same as hereinafter provided.
4 If my executors shall consider the income of my Estate insufficient for my wife’s maintenance in comfort during her life they may pay her from the principal of my Estate in their discretion so much as they may think necessary.
5 On the death of my said wife her funeral expenses shall be paid out of my Estate.
6. On the death of both my said wife and myself I give to the Roman Catholic Bishop of Harbor Grace the sum of Five Hundred Dollars for Masses for the repose of the souls of Thomas Malone late of Carbonear, deceased; Catherine Malone late of Carbonear, deceased; George Pender late of Saint John’s, deceased; Catherine Pender late of Saint John’s, deceased; and of my said wife and myself
7. I give devise and bequeath to my nephew, Maurice J. Malone, son of my brother James Malone, on the death of my wife, all my landed property at Carbonear and the household furniture at present in the house I now occupy.
8. I give devise and bequeath to my brothers and sisters (namely: Thomas Malone, James Malone, Mary Ann Sweeney, and Bridget Malone) on the death of my wife, all the residue of my Estate in equal shares: the share of any or either of them dying in the meantime going to his or her children if any then living. Witness my hand at Saint John’s aforesaid this twenty first day of July A.D. 1906. M Malone Signed Published and declared by the said Testator as and for his last will and Testament in the presence of us who at his request in his presence and in the presence of each other (all present at the same time) have hereunto subscribed our names as witnesses.
