Will of William Maher, from Newfoundland will books volume 15 pages 401 & 402 probate year 1931

William Maher.

This is the Last Will and Testament of me William Maher, of Holyrood of Conception Bay in the district of Harbour Main made this 3rd day of January in the year of Our Lord one thousand nine hundred and nineteen.
I revoke all former wills or other testamentary dispositions by me at any time heretofore made and declare this only to be and contain my last will and testament.
I hereby nominate and appoint the Capital Trust Incorporation Ltd and R. J. Kennedy to be the executor of this my will.
I direct that all my just debts, funeral and testamentary expenses be paid and satisfied by my executors as soon as conveniently may be after my decease.
I give, devise and bequeath all my real and personal estate of which I may die possessed in the manner following, that is to say: To my beloved son Aaron that piece or parcel of land commonly known as Ridleys and bounded as follows given as agreement also that piece of land known as Tom Fewers situated on the Witless Bay Line boundries given in agreement, also the piece of land at the Brown Marsh on said Line and granted from the Government, the forest land south and east from Ridleys land is also to be possessed by him specifications to be seen at the office of Mines and Agriculture.
The dwelling house barn and cellar and other outhouses to be the property of my son Aaron my wife is to hold possession and be mistress until such time as he marries and after that she is during her life to possess a room and bedroom and to be looked after by Aaron.
The white cow and heifer four sheep is to be the property of my wife to be disposed of or kept as she thinks proper if any time desirous to sell she can do so, my bed and bedding is also hers and the kitchen garden is for her use while she is active enough to till and look after it, anything remaining unmentioned on the property moveable or unmoveable belongs to my son Aaron.
The land and premises owned and occupied by my father James Maher and left to my son William who now resides in the United States is not to be trespassed upon by any one or persons but to be looked after and properly cared for until such time he may require it and should he never come to possess it he can sell or dispose of it anyway he may choose. This land is bounded as follows S.W. by Ridleys N by Witless Bay road and main road to the boundry running N.W., and N.W. by James Maher a piece of this estate is on the west of the main road and bounded by the river and James Maher N.B. The piece of land known as Larecy's is bounded by the main road on the south and local road on the north. Aaron is to hold possession of this land until such time as my son William claim it.
The piece of land on the south of Witless Bay road about two thirds of it belongs to William.
To my son James I give that piece of land situated on Salmonier road purchased from James Quinlan he can dispose of it as he wishes.
One bullock killed by train is unpaid and should I depart before payment is made the sum is to be given to my executor for distribution.
The produce of the past year is for the use of domestic purposes.
I am to be buried in a respectable manner and my soul is to receive a high Mass and two requiems the expense to be borne by Aaron. The will to be read to my family the day of my burial.
I give devise and bequeath all the residue of my estate not hereinbefore disposed of to --------
In witness whereof I have hereunto set my hand this day and year first above written.

Signed published and declared by the above named Wm. Maher testator as and for his last will and testament in the presence of us both, present at the same time, who at his request, and in his presence, and in the presence of each other, have hereunto subscribed our names as witnesses.
