Will of James Maddigan

Last will and Testament of
James Maddigan of St. John’s
Tailor deceased

      In the name of God Amen I James Maddigan of St. John’s, Tailor being of sound mind memory and understanding do make this my last will and testament. I give and bequeath to my brother Michael Maddigan for his life only my right title and interest in and to the house and land situate on the corner of Water Street and Leslie Street provided that he the said Michael Maddigan shall support and maintain my aged father during his life and pay all the funeral expenses of my father and myself and as well to pay to the Roman Catholic parish priest at Riverhead the sum of twenty dollars per year for five years to pay for Masses for the repose of my soul and the said property and my interest therein shall become the property of my nephew James Maddigan son the said Michael on the death of the said Michael. Provided that should the said Michael refuse or neglect to carry out the conditions of the bequest to him for his life my Executor hereinafter named shall proceed at once to realize all my right and interest in and to the said property and after paying the said expenses of the support of my father and of the burying of my father and myself and of the said sum of twenty dollars per annum for five years to the said Roman Catholic Parish Priest of Riverhead or so much thereof as shall remain unpaid at the time of the refusal or neglect of my said brother Michael as aforesaid and to hand the balance (if any) to my said nephew James Maddigan.
And I do nominate constitute and appoint Edward M. Jackman of St. John’s Merchant as the Executor of this my last will and Testament. Dated at St. John’s this 28th day of July A.D. 1898. (Sgd) James his X mark Maddigan. Signed published and declared as and for his last will and Testament by the said James Maddigan in our presence present at the same time who in his presence and at his request and in the presence of each other have hereunto subscribed our names as witnesses (having been read over and explained) (sgd) E. M. Jackman. (Sgd) Wm R. Howley
