In re       DECEASED.
      FRITZ E. LOVELL.

I, Fritz E. Lovell, of the town of Coaticook, in the District of St. Francis and Province of Quebec, lumber dealer, knowing the certainty of death and the uncertainty of its hour, and being of sound and disposing mind memory, judgment, and understanding, hereby make, publish and declare my last will and testament as follows; hereby revoking all former last wills and testaments by me made.

  1. I will and direct that my just debts and funeral expenses be first paid.
  2. I hereby will and bequeath to my son-in-law Osmond B. Thornton, the sum of five thousand dollars ($5,000.00) AND my diamond scarf pin.
  3. I hereby will and bequeath to my nephew Howard B. Lovell the sum of two thousand dollars and my diamond studded cuff links and shirt studs to match.
  4. I hereby will and bequeath to my nephew Merriman T. Lovell, my Shriners Jewels Knight Templars gold fob and my god headed cane and also my fruit farm at Kelowna, British Columbia, if I do not dispose of the same previous to my death and an the proprietor thereof, at the time of my death.
  5. I hereby will and bequeath to my sister-in-law, Ada Bush, widow of my late brother Charles H. Lovell, the office buildings and contents thereof, but not including any personal effects or papers, but including the vault, safe, shed and store house.
  6. I hereby will and bequeath to Sydney Lovell, son of my nephew Howard B. Lovell two large oil painted photographs of my father and mother, Mr. & Mrs. Henry Lovell.
  7. In the event of my niece Annie P. Lovell becoming a widow or being divorced from her husband, at the time of my death, I will and bequeath to her the sum of two thousand dollars.
  8. I hereby will and bequeath to Annie Saunders the sum of three hundred dollars.
  9. I hereby will and bequeath to nurse M. M. Johnston the sum of one hundred and fifty dollars.
  10. I hereby will and bequeath to Mary Belisle, the sum of fifty dollars.
  11. I hereby will and bequeath to Alex J. Sparks, the sum of eight hundred dollars
  12. I hereby will and bequeath to Gordon Pocock two hundred dollars.
  13. I hereby will and bequeath to Ernest Pocock the sum of one hundred dollars.
  14. I hereby declare that my wife Emma Jane alias Jean Morton is in community with me as to property and us therefore entitled to one undivided half of my estate and succession.
  15. I hereby will and bequeath to my said wife, Emma Jane alias Jean Morton my residence on Cutting Street, in the said town of Coaticook, being part of Cadastral lot number ninety with the buildings and improvements thereon erected and all the household furniture and other moveable effects thereon.
  16. I will and bequeath to my said wife, Emma Jane alias Jean Norton, subject to the obligations to pay the premiums and keep in force the three insurance policies on the life of my daughter, as hereinafter mentioned, the usufruct, during the whole of her natural life if she does not remarry, and until the time of her marriage, should she marry again after my decease, of my half of the community of property and every part thereof, with the exception of that herein above willed and bequeathed, including property of every nature and description, moveable, immoveable or mixed, and wherever found and situated, and hereby exempt her from giving any security regarding the enjoyment of the said usufruct, as required by law.
  17. I will and bequeath the ownership of the said property, of which the usufruct is hereby given to my wife, to my daughter Verian Arty Norton Lovell, wife of Osmond B. Thornton, who shall be entitled to the possession of the said property as owner and proprietor at the death of my said wife or at the date of her marriage, should she marry again after my decease as her own separate property (PROPRE) not responsible for the debts and liabilities of her husband.
  18. I hereby will and direct that the three life insurance policies of $5,000.00 each in the Great West Life Assurance Company, on the life of my daughter Verian Arty Norton Lovell, viz;- No 80406 dated January 12th 1914, No. P. 187166 dated September 18th 1919 and No. P. 167905 dated September 30th 1919, shall be kept in force and the premiums paid by my wife from the revenue of my estate of which she will have the usufruct.
  19. In the event of my daughter dying previous to my wife, it is my desire that my wife shall have the usufruct of the amount of the three insurances policies on the life of my daughter above mentioned, and that the amount thereof, at the death of my wife shall go to and be the property of my grandchild Margo Jean Thornton, the child of my said daughter and shall be and remain her own separate property (propre) and not fall into any community of property that may afterwards exist between her and her husband, should she marry.
  20. I hereby nominate and appoint my said wife Emma Jane alias Jean Norton and daughter Verian Arty Norton Lovell, wife of Osmond Thornton and Dr. William L. Shurtloff as the executors of this will. The said Shurtloff shall have five hundred dollars for his services as such executor which shall include all legal services (not including disbursements) except any court proceedings which may be necessary in connection with my estate. I appoint Leon M. Thomas to replace the said Dr. Shurtloff in the event of his death after my decease, and previous to the final settlement of my estate, the said Thomas to receive reasonable compensation for services rendered as such executor.
  21. I hereby prolong the powers of my executors beyond the year and a day allowed by law, until such time AS my estate may be fully settled
  22. I hereby authorize and empower my said executors to sell and deed any real estate to me belonging, without the necessity of authorization by any court or judge and relieve them from making a Notarial inventory of my estate.

In testimony whereof I have hereunto set my hand and seal at the said town of Coaticook, on this eleventh day of November, one thousand nine hundred and twenty seven, after reading hereof, with and in presence of the 3 witnesses hereto subscribing, who at my request and in my presence and in the presence of each other have signed as such witnesses.
