Will of Jabez LeGrow, from Newfoundland will books volume 15 pages 186 to 188 probate year 1930

Jabez LeGrow

This is the last will and testament of me, Jabez Legrow of Broad Cove, Retired Merchant.

  1. I hereby revoke all former wills and testamentary dispositions by me at any time made and declare this to be my last will and testament.
  2. I appoint Andrew Vatcher, of Corner Brook, Stipendiary Magistrate, and Peter LeGrow of Broad Cove, Merchant, to be the executors of this my will.
  3. I give devise and bequeath to my executors if they shall prove my will, the sum of Five hundred dollars as remuneration for their services, which said sum shall be divided between them as follows, that is to say, To the said Andrew Vatcher the sum of four hundred dollars and to the said Peter LeGrow the balance of One hundred dollars.
  4. I give devise and bequeath to my son Peter LeGrow during his life and after his death to his son Chester LeGrow all the dwelling house at present occupied by my said son Peter LeGrow and myself in common together with the land necessarily incident thereto save and except that part or portion of the said dwelling now used as a shop and wareroom by the said Peter LeGrow and Gilbert LeGrow PROVIDED ALWAYS that after the death of the said Peter Legrow his wife, Gertrude, shall have the right to personally live in the said house so long as she remains unmarried. In the event of any such re-marriage the property is to pass to Chester LeGrow absolutely.
  5. (a) I give devise and bequeath unto my sons Gilbert LeGrow and Peter LeGrow all the stores, stables and other buildings heretofore used by the said partnership together with the lands on which the same are built and all other lands at present in my name as long as they continue carrying on business in partnership on the said premises.
    (b) Should the said partnership be dissolved or the said Peter LeGrow and Gilbert LeGrow cease to carry on business in partnership by the reason of the death of either or for any other cause, I then direct that my said lands and buildings be partitioned as follows, that is to say.
    1. Unto and to the use of my son Peter LeGrow, his executors, administrators or assigns provided he or they shall carry out the request contained in paragraph four following in this my will, all those stores, stables and appurtenances on all that piece or parcel of land where my dwelling house is located
    2. To my son Gilbert Legrow his executors administrators and assigns, the coal shed, liver factory and so much of the land as is necessary for the operation of the said factory also the provision and fish stores.
    3. The balance of the properties shall be portioned as agreed upon between the said Gilbert Legrow and the said Peter Legrow or as their executors administrators or assigns may determine.
    4. As the provision and fish stores hereinbefore referred to are at present built on the land in the name of Peter Legrow, the said Peter LeGrow his executors administrators or assigns shall in consideration of the bequest hereinbefore contained assign and convey the said land to the said Gilbert Legrow; and should the said Peter LeGrow fail to so assign and convey the said lands then the bequests to him by this will shall lapse.
    6. I give devise and bequeath to my son Arthur LeGrow the property on the bank. This bequest is subject to the condition that it shall not pass out of the family.
    7.  I hereby declare that apart from the property hereinbefore described I have no interest in the firm or business which has latterly been carried on by my two sons Gilbert LeGrow and Peter LeGrow.
    8. All the rest residue and remainder of this my estate I give devise and bequeath to my executors in trust for the following purposes, namely:
    To pay my debts, funeral and testament expenses and the balance to distribute as they in their sole discretion may deem fit equally in point of market value among the following grand-children, or in the event of the death of any of them, their next of kin per stirpes, that is to say Ronald Vatcher, Jabez Roy LeGrow, Ralph LeGrow, Pearl LeGrow, Charles Lloyd LeGrow, Raymond LeGrow, Frank LeGrow, Gwendolyn LeGrow, Chester LeGrow and Cyril LeGrow, and I authorise my said executors to call in and convert into cash any or all of my said investments to facilitate them in the said distribution.

IN WITNESS WHREOF I the said Jabez Legrow have to this my will set my hand this twenty second day of June A.D. 1927

This is a codicil to my last will and testament dated the 22nd day of June A.D. 1927.
The bequest to my grandson Chester LeGrow in paragraph (4) of my said last will is subject to the following proviso, that is to say, should my said grandson Chester Legrow leave Broad Cove, and for this or any other purpose desire to dispose by sale of the property herein referred to, then and in such event he shall give members of the family residing in Broad Cove a first opportunity to purchase the property referred to in the said paragraph (4) at the price at which same shall be subsequently offered and sold.
IN WITNESS WHEREOF I the said Jabez LeGrow have to this codicil set my hand this fourteenth day of June 1929.
