Will of Peter Leary
from Newfoundland will books volume 13 page 148 probate year 1925

In re
      PETER LEARY.     DECEASED.

This is the last will and testament of me Peter Leary of the Torbay Road in the Electoral District of St. John’s East, Farmer.

I revoke all former wills by me at any time made, and I appoint my son Patrick the executor of this my will.

I give and bequeath all the property of whatsoever kind I may die possessed to my wife Catherine for her own use during her lifetime. Upon the death of my said wife my said property is hereby bequeathed by me as follows, namely: - To each of my daughters Margaret Bridget and Catherine one half acre of the land on the Torbay Road known as the “Pond Field”: To my said two daughters Bridget and Catherine equally between them the furniture in the Parlour of my home at present: to my son Philip the house in which I at present reside, with the land on which the same is built; All the rest and residue of my property, including in particular the remainder of the “Pond Field”, the balance of my household furniture, and the whole of my farm property (except the bequest to Philip above) together with my Stables and barns, my farm stock and farm implements to my three sons, Patrick, Richard and Philip in equal shares between them as tenants-in-common.

In witness whereof I have hereunto subscribed my hand at St. John’s this third day of November, A.D. 1917.    PETER his X mark LEARY

Signed, Published and declared by the Testator as and for his last will and testament in presence of us, both being present at the same time who at his request and in his presence have hereunto subscribed our names as witnesses attesting the due execution hereof, the same having been first read over and explained to the Testator who appeared perfectly to understand the same and who signed the same by making his mark thereto in our presence, the wordsMargaret”, “half” and “Bridget” and Catherine” having been first inserted as indicated by the initials opposite each insertion.
