IN RE. DECEASED
EDWARD KNIGHT.
This is my last will and testament.
- I leave all my property of whatsoever description to my executors upon trust to dispose of the same as hereinafter provided.
- My executors shall hold the said property until the same shall devolve upon some person having a permanent and unqualified interest.
- I direct my executors to pay regularly all ground rent Insurance and other charges and to them I leave the possession and management of any moneys that may have accrued or may hereafter accrue from my said estate. Such money be deposited in the Newfoundland Savings Bank on interest and shall be held by my executors to provide against ground rent Insurance repairs and other costs and expenses.
- I give devise and bequeath my landed property and furniture to my wife Matilda for her sole and separate use during her life and after her death to my daughter Anne Tynes Knight if she be then unmarried but not otherwise.
- After my wifes death if the said Anne Tynes be not a spinster or if being then a spinster she afterwards marries then on either of such events my landed property shall thereafter beheld by my executors upon trust to permit such of my daughters as may be from time to time widows to reside in the said house.
- Upon the death of all my daughters I devise and bequeath the said property
and money (if any then remaining) to the Right Reverend Doctor Jones Lord Bishop of Newfoundland and his successors in office and to the said Reverend Ambrose Heygate for the benefit of the poor of the Cathedral Congregation of St John's to apply as they shall think fit and proper.
- None of my said daughters shall assign sell mortgage or in any way encumber any share or interest hereby given and if any of them shall assume to do so or if any of them shall suffer any share or interest to be seized attached or levied on for any debt claim or judgment or if any shall be declared insolvent, then such interest or share shall be forfeited by such person and shall pass to the others or other of my daughters who may be otherwise entitled to the same under this will.
- In event of the house being burnt the insurance money shall be applied to rebuild it, my executors shall insure and keep insured the said house in the sum of at least one hundred and fifty pounds.
- Any money remaining after the decease of my said daughters shall go to my son Edward George Knight or if he not then alive then to my son Aris(?).
I appoint the Reverend Ambrose Heygate and my son Edward George Knight executors of this my last will and testament.
