In re Thomas Kennedy       deceased

In the name of God Amen I Thomas Kennedy of Trepassey in the District of Placentia and St. Marys Farmer to vow and declare this to be my last Will and Testament. I will and bequeath to the Church for Masses for the Repose of my soul one hundred dollars $100.00. I will and bequeath to the Church for Masses for the Repose of the souls in Purgatory one hundred dollars $100.00. I will and bequeath to my Brother Samuel Kennedy two hundred dollars $200.00. I will and bequeath to my Brother Cornelius Kennedy one hundred and fifty dollars $150.00. I will and bequeath to my Brother Matthew Kennedy two hundred dollars $200.00. I will and bequeath to my Brother Edward Kennedy one hundred and fifty dollars $150.00. I will and bequeath to my sister Rosanna Neil one hundred and fifty dollars $150.00. I will and bequeath to my sister Anastasia Waddleton one hundred and fifty dollars $150.00. I will and bequeath to William Kennedy son of Patrick Kennedy seventy-five dollars $75.00. I will and bequeath to Samuel Kennedy son of Patrick Kennedy seventy-five dollars $75.00. I will and bequeath to Edward Moors one hundred and fifty dollars $150.00. I will and bequeath to my wife Bridget Kennedy four hundred dollars $400.00. I will bequeath to my nephew Michael Kennedy son of Edward Kennedy my piece of land around my Dwelling House bounded thus on the North side by Deep Cove barrens. East by my Brothers Edward and Cornelius land on the south by Fishing room, on the west by Brothers Samuels and Matthews land I also will and bequeath to Michael Kennedy son of Edward Kennedy my part and claim of fishing room, stage, and store Houses. I will and bequeath to my wife Bridget Kennedy my Dwelling House and all my out Houses and cellar as long as she lives I will and bequeath that after her death My Dwelling House, all my out Houses and cellar shall go to my nephew Michael Kennedy son of Edward Kennedy I will and bequeath to Edward Moors the South west Half of my Piece of Land situated in the North East Arm and bounded on the North West side by Crown land, and on the North East by Matthew and Cornelius Kennedy's land, on the South East by salt water, and on the South west by James Malloy's land. I will and bequeath to Edward Moors my small iron bed sted bed and bedding. I hereby appoint my Brother Matthew Kennedy and my nephew Michael Kennedy to be my Executors Thomas Kennedy. Kennedy    Thomas Kennedy Signed by the said Thomas Kennedy in our presence and by us in his presence and in the presence of each other this twenty eight day of March in the year of our Lord nineteen hundred and thirteen.

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor. We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
