Will of Esther Kelly from Newfoundland will books volume 15 page 572 probate year 1932

IN RE          DECEASED.
Esther Kelly

I, Esther Kelly of St. John's in the Island of Newfoundland, widow hereby revoke all former wills, codicils and testamentary dispositions heretofore made by me and declare this to be my last will and testament.

  1. I appoint my son James Kelly the Executor of this my will.
  2. I direct my executor to pay all my just debts funeral and testamentary expenses.
  3. I give and bequeath unto my said son James Kelly my farm in Kilbride consisting of land and buildings for the term of his natural life and after his death unto my four grandchildren, namely Richard Kelly, and William Kelly and Joseph Doyle and Maurice Doyle absolutely share and share alike; children of deceased children taking their deceased parents share.
  4. I give and bequeath unto my said son James Kelly absolutely all my household furniture and effects, my horse, car, catamaran, harness and appurtenances and all and singular my farming utensils implements and machinery of whatever kind soever.
  5. I give and bequeath unto my said son James Kelly absolutely all my share and interest in the business at present conducted by my son James on George's Street, St. John's aforesaid.
  6. I give devise and bequeath unto my said son James and my daughter Esther Doyle absolutely share and share alike my freehold land together with dwelling house and shop and all other buildings and erections thereon situate on the south side of George's Street aforesaid and lately occupied by me.
  7. I give devise and bequeath unto my said daughter Esther Doyle my land situate on Buchanan Street, St. John's aforesaid, together with the building at present used as a garage and all other buildings thereon absolutely.
  8. The rest residue and remainder of my estate and effects not heretofore specifically mentioned I give devise and bequeath unto my said son James Kelly and my said daughter Esther Doyle absolutely share and share alike.
  9. I desire my said son and daughter at all times to preserve friendly relations and live in the closest harmony without dispute or differences.

In witness whereof I have hereunto subscribed my hand at St. John's aforesaid this 23rd day of August A.D. one thousand nine hundred and thirty.

Signed Published and Declared by the above named testatrix as and for her last will and testament in our presence who in her presence at her request and in the presence of each other all three being present at the same time have hereunto subscribed our names as witnesses, the said will consisting of two pages of which this is the second page, first having been read over and explained to the said testatrix.
