Will of Terrence Kelley Senior
from Newfoundland will books volume 8 pages 412 to 414 probate year 1908

In re
      Terrence Kelley          deceased.

      In the Name of God Amen. The last will and testament of Terrence Kelley of the Torbay road District of St. John’s East N.f.l.d. Farmer & Fisherman:- made this day July 4th 1907 July the fourth nineteen hundred & seven. I Terrence Kelley Sr being very sick and indisposed in bodley health but of perfect and sound mind and memory & of good understanding and calling to mind the frailty and uncertainty of human life and that it is appointed for men once to die & Therefore I am desirous to settle my worldly affairs and direct how the estate with which it has pleased God to bless me with shall be disposed of after my decease while I have strength and capacity to do so: Do make and publish this my last will and testament hereby revoking and making null all other wills and testaments by me at any time heretofore made

Fist I constitute and appoint my Son Terrence Kelley Jr. sole executor of this my last will directing him to pay all my just debts and my funeral expences and the Legacies hereinafter mentioned out of my Estate -

Secondly I do will and bequeath unto him my son Terrence Kelley my dwelling House and Barns one Horse four Cows one milchs car one Express waggon & Farming Implements Together with my farm Situated on the west side of the Torbay road Bounded as follows N by Ellards and James Kelley S by Martin Kennedy’s river E by the Main road W by Michael Bulger and Larkins land Further I do will and bequeath unto my son Terrence Kelley a piece of land on the west side of the Torbay road for which there is a Grant to be raised fourteen acres founded as follows N Michael Brine E Torbay Road S Satler W by a piece of the same Land but to be Robert Kelleys.

Secondly I do hereby will and bequeath unto my son Robert Kelley a piece of land situated west of the land (for which he have a Grant) To have and to hold the same Twenty acres under consideration that he Robert Kelley pay the surveyors fee and government aie:

Thirdly I do hereby will and bequeath that my Beloved wife Johanah Kelley shall have full controll of my House and farm while she lives and in consideration
If there is any disagreeing she shall have one end of my dwelling house to herself and also to to be maintained out of my Estate - But after her death It shall be the property of my son Terrence Kelley as aforementioned Terrence his x mark Kelley Sr. Signed sealed published and declared by the said Terrence Kelley Sr. as and for his last will and testament in presence of me who in the presence of him and in the presence of each other and at his request have subscribed my name hereto as witness witnesses John Roche    Edward Cantwell
