Will of Thomas Keefe
(from Newfoundland will books vol 11 pages 40 and 41 probate year 1917)

In re Thomas Keefe deceased

I Thomas Keefe of Burnt Cove Friday's Bay being of sound mind and memory do make and publish this my last will and testament in manner and form following, that is to say.

  1. I give and devise unto my daughter Elizabeth Emma Butt one-half of my land situate at Burnt Cove Friday's Bay for her sole use and benefit forever but at her death said property is to become the property of my grand-son William James Butt.

  2. I give and devise unto my nephew Isaac Keefe all erections thereon except one building which is the property of my son-in-law John C. Butt.

  3. I give and devise the remainder {one-half} of my land to my nephew -Isaac Keefe. The divisions to be the same as made by myself sometime past.

  4. In the event of my nephew Isaac Keefe dying and leaving no son, then in that case the part of land devised to him is to become the property of my said daughter and at her death to my grand-son William James Butt.

The above bequests are on the following condition {a.} That my nephew, Isaac Keefe is to support my wife as long as she remains my widow, and allow her to live peaceably with him but in the event of my nephew dying before my wife then in that case my daughter is to support my wife as long as she remains my widow.

Lastly I hereby appoint and constitute my daughter Elizabeth Emma Butt my executrix of this my last will and Testament, and hereby revoking all other wills by me made. In witness whereof I hereunto set my hand this first day of June A.D. 1917 Thomas his X mark Keefe signed in the presence of Ada Jane Janes and Charles White M.P.

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
