In re
Thomas Kavanagh deceased.
This is the last will and testament
of me Thomas Kavanagh of St. John’s in the Island of
Newfoundland labourer.
First I direct that my executor hereinafter named shall
first pay my just debts funeral and testamentary expenses.
Secondly:
I devise and bequeath unto my son Garrett Kavanagh all my interest in the land
and premises on which I now reside but this bequest is made subject to the
condition that my daughter Katherine shall have the right to live with my said
son Garrett on the said premises, until she marries or leaves of her own accord.
Thirdly:-
I give and bequeath unto my daughter Katherine Kavanagh the sum of one hundred
dollars the said sum being amount of life insurance payable upon my death by
the Newfoundland Fishermen’s Star of the Sea Life Insurance Department under
policy number 88.
Fourthly:- I hereby appoint James Kirby of St. John’s
fisherman executor of this my last will and testament.
Fifthly:- I hereby revoke
all testamentary dispositions heretofore made by me. In witness whereof I have
hereunto my hand subscribed by making my mark at St. John’s
aforesaid this twenty-fourth day of August Anno Domini one thousand nine hundred
and eight (sgd) Thomas his x mark Kavanagh. Signed by the testator as and for
his last will and testament in the presence of us who in his presence at his
request and in the presence of each other have hereunto subscribed our names
as witnesses, the word “dollars” on line 17 having been first inserted
and the said will and testament having been first read over and explained and
the words “by making his mark” having been first inserted (sgd)
