Will of Mary Joy from Newfoundland will books volume 14 pages 591-592 probate year 1929

In re     DECEASED.
MARY JOY.

I, Mary Joy of St. John's in the island of Newfoundland widow hereby revoke all former wills and codicils by me made and declare this to be my last will and testament.

I appoint James P. Colford of St. John's shoe-maker and my daughter Katherine Mary Joy executors of this my will.

  1. I declare that my just debts and my funeral and testamentary expenses shall be paid out of moneys at my credit in the Royal Bank of Canada at St. John's West.
  2. I give and bequeath the remainder of my said bank account in equal shares to my daughter Mrs. Teresa Comerford and my son Thomas.
  3. I devise and bequeath my leasehold property on New Gower Street to my daughters Katherine Mary Joy and Ida Margaret Joy as tenants in common in the interests following namely two=thirds to the said Katherine Mary Joy and one third to the said Ida Margaret Joy.
  4. I bequeath all my furniture and effects in my house situate on New Gower Street excepting anything contained in my shop therein to my daughters Katherine Mary and Ida Margaret in equal shares.
  5. I bequeath all the stock book debts and trade fixtures contained in my shop to my daughter Katherine Mary.
  6. I devise the farm with dwelling house barn and slaughter-house thereon situate on Cornwall Avenue and now enjoyed by my son William to my son William for his life and then to his eldest daughter or on her predeceasing him to his eldest child surviving him this devise is subject to paragraphs 7, 8 and 9 hereof.
  7. I declare that my son Peter shall have the right to use and enjoy with my son William and his successors the slaughterhouse and yard thereto appertaining hereinbefore referred to during his life.
  8. From my said farm I devise to my son Albert a parcel of land fifty feet square fronting on Cornwall Avenue and having a side of the said parcel of land bounded by Cornwall Avenue aforesaid. This said parcel of land shall be determined by mutual agreement between my sons William and Albert.
  9. From my said farm I devise to my daughter Ida Margaret a parcel of land fifty feet square fronting on Cornwall Avenue and having one side of the said parcel of land bounded by Cornwall Avenue aforesaid. This said parcel of land shall be determined by mutual agreement between my son William and my daughter Ida Margaret.
  10. All the rest and residue of my estate whatsoever I bequeath and devise to my sons William and Peter.

IN WITNESS WHERE OF I have set my hand at St. John's aforesaid this 30th day of April Anno Domini one thousand nine hundred and twenty nine

Signed by the said Mary Joy as her last will in the joint presence of herself and us who at her request and in such joint presence have hereunto subscribed our names as witnesses.
