Will of Euphemia Isabella Hutchings

In re
Euphemia I. Hutchings deceased.
This is the last will and testament
of me Euphemia I. Hutchings of St. John’s in the Island
of Newfoundland, widow.
First. I hereby revoke all testamentary dispositions
by me at any time made and declare this to be my last will and Testament.
Second.
I appoint my son Charles H. Hutchings and my daughter Olivia
McN. Hutchings,
Executor and Executrix respectively of this my will.
Third. I
give devise and bequeath unto my son John S. Hutchings all that piece or
parcel of land together with all buildings and erections thereon situate
on the Thorburn Turnpike and known as “Jubilee Farm” absolutely.
Fourth. I give, devise and bequeath unto my son Charles H. Hutchings all
my farm lands of every kind nature and description situate off the Newtown
Road together with all buildings and erections thereon absolutely.
Fifth.
I give and bequeath all my household furniture, goods wares, chattels and
effects and all my personal effects of every kind nature and description
to my daughter Olivia McN. Hutchings absolutely.
Sixth. I give
and bequeath all my shares in the Newfoundland Oil Co. to my daughter Olivia
McN. Hutchings absolutely.
Seventh. I give devise and bequeath
all my piece or parcel of land together with the double dwelling house
stables out-houses and all other buildings and erections thereon situate
on the corner of Parade Street and Freshwater Road unto my daughter Olivia
McN. Hutchings absolutely.
Eighth. I will and direct that all
my just debts funeral and testamentary expenses shall be paid out of such
moneys or securities of money which I may own at the time of my death.
Ninth.
I give devise and bequeath all my mining claims and properties to such
of my children as shall be living at the time of my death to be divided
equally between them.
Tenth. I direct that all the rest residue
and remainder of my property be realized and invested and that the income
thereof be paid to my daughter Olivia McN. Hutchings during her life and
upon her death that the same be distributed as follows:-
- To
my daughter Ada S. Smallwood Five hundred dollars,
- to
my grand-daughter Lilian E. Parker Two hundred and fifty dollars,
- to
my grand-son Wesley Smith Suthergreen Two hundred and fifty dollars.
- I
direct that upon the death of my said daughter Olivia McN.
Hutchings as aforesaid my executor and executrix pay to my daughter Elizabeth
J. Pigot the income of Fifteen hundred dollars which is to be invested according
to the absolute discretion of my said executor and executrix during
her life and upon her death to distribute the said sum of fifteen hundred
dollars equally amongst my children then living.
- To the daughters
of my son Charles H. Hutchings who may be living upon the death of
my said daughter Olivia McN. Hutchings I give and bequeath the balance to
be divided equally between them.
Eleventh. I hereby declare
that all moneys liable to be invested under this my will may be invested
on Government securities or any stocks, funds or securities authorized
by law for trust funds or on mortgage of any land or houses either freehold
or leasehold.
In witness whereof I the said Euphemia I. Hutchings have hereunto set my hand to this my last will and Testament at St. John’s
aforesaid this fourteenth day of November Anno Domini one thousand nine
hundred and six Euphemia Isabella Hutchings signed by the above named Euphemia
I. Hutchings as her last will and Testament
in the presence of us both being present at the same time who in her presence
and in the presence of each other have hereunto subscribed our names as
witnesses W. E. Wood St. John’s Solicitor Jas.
