OATH OF AMINISTRATOR

WITH THE WILL ANNEXED.

 

Administration granted to Ruth Gardner on the 21st day of December 1909

To the Honourable the Supreme Court, or to one of the Honourable the Judges thereof, The Petition of Ruth Gardner of St. John's in the District of St. John's, Married Woman,

Humbly Showeth

  1. That Rachel Hussey late of Salmon Cove in the Electoral District of Port de Grave, Widow, died there on the 6th day of September, A.D.1900, having first made and published her last will and testament, which is hereto annexed and marked "A" and duly proved, and of which she appointed James Charles Harvey executor. The said James Charles Harvey died subsequently to the death of the said Rachel Hussey, but without proving the said will or intermeddling with the estate of the said Rachel Hussey.
  2. That Rachel Parsons a daughter of the said Rachel Hussey predeceased her mother and left no child or husband. The said Rachel Hussey left her surviving at the time of her death as sole next of kin one daughter, Your Petitioner.
  3. That the said Rachel Hussey left property within the jurisdiction of Your Honourable Court at the time of her death of the probable value of four hundred dollars and that hereto annexed and marked "B" is a just and true inventory and valuation of the same so far as your Petitioner can at present ascertain the same.
  4. That no probate of any will or letters of administration to the said estate have been granted or applied for.

Your Petitioner therefore prays that letters of administration with the will annexed to the estate of the said Rachel Hussey may be granted to Your Petitioner.

And, as in duty bound, Your Petitioner will ever pray, etc.

In the matter of the will and estate of the late Rachel Hussey of Salmon Cove in the electoral district of Port de Grave, Widow, deceased.

St. John's , ss.
      I Ruth Gardner of St. John's aforesaid, Married Woman, make oath and say that I am the petitioner in the foregoing petition named and that all the matters and things in the said petition contained are just correct and true to the best of my knowledge information and belief.

This is the will of Rachel Hussey marked "A" referred to in the annexed affidavit of William F. Turner sworn before me the seventh day of Decem. A.D. 1909 - A. J. G. MacE??ben A commissioner of the Supreme Court of Newfoundland for the Province of Nova Scotia

I, Rachel Hussey, widow, now residing at Salmon Cove, Conception Bay, Newfoundland being of sound mind, thus publish and declare my last will and Testament Revoking and annulling all former dispositions of my property. I give and bequeath as follows. Whatever money I may have at my decease after payment of my just debts to be equally divided between my two daughters, Rachel Parsons and Ruth Hussey and in the event of the decease of either of said daughters the said money to become the property of the survivor.

The House and Land situated at Salmon Cove I bequeath to my two daughters above mentioned so long as they remained unmarried and in the event of the marriage or decease of either to become the property of the survivor.

I appoint James Charles Harvey, Clerk, as Executor to this my last will and Testament dated the 17th day of July 1889. Rachel (her x mark) Hussey.

Signed, acknowledged and declared by the Said Rachel Hussey as and for her last will and Testament, the same having been read over to her in the presence of us who being present at the same time, in her presence and in the presence of each other have hereunto subscribed our names as witnesses.
