Will of Thomas Hillier from Newfoundland will books volume 14 pages 131-132 probate year 1927

In re
      THOMAS HILLIER.       DECEASED.

THIS IS THE LAST WILL AND TESTAMENT OF ME, Thomas Hillier of Taylors Bay presently residing at Taylors Bay Lamaline Newfoundland, I hereby revoking all former Wills at any time made by me, and being desirous of settling my affairs in the event of my decease, and having full confidence in the persons afternamed as Trustees and Executors, do hereby give, grant, assign, dispose, convey and make over to, and in favor of John Foote Fisherman of Lamaline Newfoundland and S. G. Spurrell of Lamaline Parish Newfoundland and the survivor of them, as Trustees and in Trust for the purposes aftermentioned the whole Estate and Effects, heritable and movable, real and personal, presently belonging to me and that shall belong to me at the time of my decease, together with the whole Writs and Vouchers thereof; and I nominate and appoint the said John Foote and S. G. Spurrell and the survivor of them, to be my sole Executors and Trustees of this my Will, but declaring that these presents are granted in Trust always for the purpose aftermentioned, viz:
(First) I direct my Executors and Trustees to first pay my just debts, personal and testamentary expenses
Secondly I give, devise and bequeath unto my sons, Charles and Edgar Hillier the Western meadow to be divided equally between them, and to my sons Edgar and Kenneth Thomas Hillier the meadow, Western from land now owned by Wm G. Hillier, to be divided equally between them. And the meadow on the back of the Stable to be equally divided between Edgar, and Charles Hillier, and to my son Kenneth Thomas Hillier, the land now under cultivation, on the back of the meadow last mentioned. And to my son Edgar Hillier, the piece of land whereon his House now stands, and to my son William George Hillier, that piece of land upon the Hill, bounded on the East, by land owned by Wm J. Bonnell and on the North, West and South, by land owned by Reuben Hillier, and to my sons, Kenneth Thomas and Charles Hillier that piece of land, bounded on the East by land owned by Albert Hillier and on the West, by land owned by John Woodland, and on the South by the Sea-shore, to be equally divided between them, and to my sons, Edgar and Charles Hillier the land, known as the Sandy Garden, to be equally divided between them.
I give, devise and bequeath, to my sons, Edgar and Charles Hillier, the fishing Stage, and to my son Kenneth Thomas Hillier, the Little Beach, and to my son Edgar Hillier the Eastern Beach, and to my sons, Edgar, Kenneth Thomas and Charles Hillier, the fish Store, to be equally divided among them, and to my sons Kenneth Thomas, and Charles Hillier the Stable.
I give, devise and bequeath, to my son Charles Hillier the Dwelling House and its contents, I direct, that after my death, one hundred dollars, be given to erect a headstone, for myself and wife, in St. Marys, Cemetery, Lamaline, and the balance of money that I may die possessed of to be divided equally, among my four sons, Wm George, Kenneth Thomas, Edgar, and Charles Hillier, and my two daughters Delneh Gillard and Emily. And I reserve my liferent, and full power to alter, innovate, or revoke these presents in whole or in part. And I dispense with the delivery hereof And I consent to the registration hereof for preservation.
In Witness Whereof I have subscribed these presents written (in so far as not printed) by John Foote, Fisherman Lamaline Nfld. at Lamaline this eighteenth day of August Nineteen Hundred and Twenty Seven.

SIGNED, published and declared by the above-named Testator as and for last Will and Testament in the presence of us both present at the same time, who at his request and in his presence have hereunto subscribed our names as witnesses.
