In re DECEASED.
ROBERT HILLIER.
I Robert Hillier of Lamaline in the island of Newfoundland fisherman hereby
revoke all former wills and Testamentary dispositions made by me and declare
that this is my last will.
I appoint Robert Pittman of St. John's,
Newfoundland, Police Constable to be the Executor and Trustee of this my will.
I
will devise and bequeath my dwelling house, shop (under the same roof) and
all household furniture and articles of domestic use contained therein to my
Trustee upon Trust that he shall permit my wife to have the use and enjoyment
thereof during her life and after her decease upon trust to permit my son Chesley to use occupy and enjoy the same until such time, within ten years, as my son
Frederick shall return to Lamaline and signify his intention to my Trustee
of residing there; and if my son Frederick shall not return to Lamaline within
ten years after the death of my wife I declare that my Trustee shall stand
possessed of the said premises upon trust to convey the same to my son Chesley in fee simple to be his absolutely; but if my son Frederick shall return to
Lamaline within ten years and signify his intention of residing there then
to convey the same to my son Frederick to be his absolutely.
I will
devise and bequeath the stock-in-trade which may be in my shop hereinbefore
referred to to my wife to be hers absolutely, and One thousand Dollars ($1000.00)
to be hers absolutely.
I will devise and bequeath all that piece
or parcel of land together with all buildings and erections thereon at Lamaline
situate between land of one Frederick Hillier and of one Cyrus Hillier to my
son Chesley to be his absolutely.
I will devise and bequeath all
other pieces or parcels of land together with all buildings and erections thereon
situate at Lamaline (including property situate at High Beach and all buildings
and erections thereon) unto my Trustee upon Trust to divide the same equally
amongst my three sons Frederick Lewis and Chesley and to convey the right to
my son Chesley to use and occupy the share of my sons Frederick and Lewis until
each shall have, within ten years, signified to my Trustee his intention of
residing at Lamaline and actually taken up residence there; and in the event
of either or both of my said sons Frederick and Lewis not returning to Lamaline
within the said ten years after my decease I declare that my Trustee shall
stand possessed of the property otherwise belonging to my son or sons not returning
to Lamaline and residing there within the said period of ten years from the
date of my death upon trust to convey the same to my son Chesley to be his
absolutely.
I will devise and bequeath all my shares and bonds of
the Fishermans Union Trading Company to my son Chesley to be his absolutely.
I
will devise and bequeath all my real and personal estate whatsoever and wheresoever
not hereby or by any Codicil hereto specifically disposed of unto my Trustee
upon Trust to divide and convey the same amongst my sons living at the time
of my death to be theirs or his absolutely. I desire that neither my Trustee
nor any beneficiary hereunder convey any land comprised in my estate unto any
other than members of the Hillier family of Lamaline.

SIGNED by the above named Robert Hillier as his last will
and testament in the joint presence of himself and us, who at his request and
in such joint presence have hereunto subscribed our names as witnesses.
