Will of Thomas Hicks
from Newfoundland will books volume 8 page 100 probate year 1906.
This will is also recorded, without the fiat comments in the margin, in volume 8 page 203-204 probate year 1906.

In re
     Thomas Hicks       deceased.

This is the last will and Testament of me Thomas Hicks planter residing at Durrell's Arm Twillingate Newfoundland.
Firstly I give and bequeath to my son John the old house formerly occupied by me, to do with as he deem best.
Secondly I give and bequeath to my son John, the new meadow situated at back of my new house, for his own use and benefit, to do with as he deems best.
Thirdly I give and bequeath to my wife and my four grand-children namely, William oldest son of John, John next eldest son of John, Stanley John son of Samuel and Joseph eldest son of James, during their lifetime the whole of my room
Fourthly I give and bequeath to my grand-child William eldest son of John, a piece of fenced land about half an acre, situated on top of a spot called "grandma's flat" and about a quarter of a mile from my residence (a public right of way divides this piece of land from the new meadow.
It is to be understood that the third bequeath which has reference to my wife and my four grandchildren is made with the understanding that the parents namely, that the fathers of the above named grand children are to maintain my wife, that is by giving an equal proportion towards her support during her lifetime if the parents namely the fathers of any of the grand children refuse on any account to maintain my wife in equal proportion during her lifetime then the share of my room belonging for the son of the parent thus refusing, to be divided amongst the remaining grandchildren, the refusing to mean the parent or parents of any of the before mentioned grand children objecting or being unable to maintain my wife in equal proportion during her life time This section only applies so long as my wife remains unmarried after my death. Should my wife again marry then all further maintenance to cease I might here add that the new meadow, and the piece of fenced land situate at back of house does not apply to the section there so belonging to my room as both these spots have been taken in at a later date
And I appoint James Young son of late Simon Young of Twillingate and Samuel Minty son of late George Minty of Twillingate to be the executors to this my sole and only will
In witness whereof I hereunto set my mark this twentieth day of May in the year of our Lord one thousand eight hundred and ninety nine. Thomas his x mark Hicks

Note: The wills in those will books are NOT actual wills. They are hand-written copies of a, "last will and testament," written by the court clerk, after the death of the testator, when the executor presented them to the court for probate. The court clerk didn't list the signatures at the bottom, he (or she) just put them in the book in whatever order they were in, on the original document, no spacing most of the time, no punctuation. The originals were kept by the executor.

We who have typed these wills, have made every effort to include all the errors that were on the microfilm, in order to avoid destroying the integrity of the originals, where ever they may be.
