Will of Laura W. Hayward

Last Will and Testament of
Laura W. Hayward of St. John's
Widow deceased.

      This is the last will and Testament of me Laura W. Hayward of St. John's widow

1. I direct that all my just debts and funeral and testamentary expenses shall be first paid out of my estate.

2. I devise to Mina Louisa Simms the sum of one hundred dollars.

3. As regards the rest and residue of my said estate whether real or personal and being in Newfoundland, Canada or elsewhere I direct that it shall be divided into Twenty one equal parts of shares and distributed as follows.

  • To my daughter Anna Rebecca wife of the Reverend John Hewitt two shares.
  • To my daughter Julianna L. Simms widow of the late Doctor Simms two shares.
  • To my daughter Kate Eagar wife of the Reverend C. L. Payne two shares.
  • To my daughter Emma Maude wife of George LeMessurier two shares (subject to reduction as hereafter set forth)
  • To my son Robert Henry Hayward two shares.
  • To my son William A. S. Hayward Two shares.
  • To my son Arthur T. S. Hayward two shares
  • To my son George Makinson Hayward two shares - (subject to reduction as hereafter set forth)
  • To my son Frederick C. W. Hayward two shares.
  • To my son Harrison R. Hayward two shares.
  • To Harry, Charles, Thomas and John children of John W Hayward one share between them (to be applied as hereafter set forth).

The bequests to my said daughters are to be for their sole and absolute use and benefit and free from the control of any husband or husbands with whom they may intermarry. In the event of the death of any of my said sons or daughters before my death it is my will and I hereby direct that the bequest or bequests to him her or them shall not lapse but shall go to the executors and (or) administrators of such deceased child or children for the benefit of his, her or their estate or estates.

The bequest to my daughter Maude shall be subject to a reduction of Two hundred dollars which amount shall be deducted by my executors and distributed amongst my other children share and share alike and the executor and (or) administrators of any child or children who shall have predeceased me. The bequest to my son George shall be subject to a reduction of four hundred dollars which shall be deducted and applied as is provided for the distribution of the amount to be deducted from my daughter Maude.

I direct that the interest upon the bequest to the children of the said John Hayward shall be paid to their mother Louisa Hayward to be applied by her towards their support and maintenance until the youngest or youngest survivor of them shall have attained the age of twenty one years when the principal shall be equally divided amongst the survivors.

I appoint my sons Arthur T. S. Hayward and Frederick C. W. Hayward Executors of this my last will and revoke all former wills by me at any time made. (Sgd) Laura W. Hayward. Signed Published and declared by the said Testatrix as her last will and Testament in the presence of us who in her presence and in the presence of each other have hereunto subscribed our names as witnesses this 20th day of April A.D. one thousand eight hundred and ninety three (sgd) J Augustus Clift Solicitor.
